In a financial thriller that spans borders, federal prosecutors in Massachusetts dropped a bombshell on Thursday, announcing the indictment of a former California attorney, Luis Carrillo, and four Canadians, including Frederick L. Sharp, in an alleged $140 million pump-and-dump scheme. The charges, including criminal securities fraud, have sent shockwaves through legal circles, uncovering a sophisticated pump and dump scheme that spanned nearly a decade.

The Accused: Former Attorney and Canadian Co-Conspirators

Luis Carrillo, a 50-year-old former securities attorney from California, has been thrust into the center of the storm, along with Canadians Frederick L. Sharp, Courtney M. Kelln, Mike K.G. Veldhuis, and Paul Sexton. These individuals now face criminal securities fraud charges, with Carrillo believed to be in Mexico at present. The intricate web of allegations suggests a calculated scheme involving multiple players.

The "Q" Platform: A Web of Deception Unveiled

At the heart of the alleged scheme is Frederick L. Sharp, who, according to the indictment, created a clandestine platform named "Q." This platform played a pivotal role in masking participants' identities during the sale of substantial shares. Sharp's ingenuity involved creating companies to hold shares, employing encrypted communication channels, and collaborating with a Swiss asset management firm, Wintercap SA, to process stocks in a manner that avoided detection.

Prosecutors assert that Sharp leveraged the Q system to track total holdings and facilitate payments through fictitious invoices, all while promoting his services as a means of "keeping clients out of jail."

While Sharp orchestrated the covert platform, Carrillo, Veldhuis, and Sexton engaged in promotional campaigns for the controlled stocks. Courtney M. Kelln is accused of creating documents pivotal in the transfer of stocks. The indictment spans a period from 2012 to 2020, revealing a prolonged and intricate financial plot.

California Attorney Indicted in $140M Pump-and-Dump: Anatomy of the Scheme

The pump-and-dump scheme typically involves an investor purchasing low-value stocks, transferring them to shell entities, and then artificially inflating their value to deceive unsuspecting investors. In this case, the indictment identifies four companies whose shares were manipulated between 2015 and 2018, resulting in substantial proceeds: OneLife Technologies ($5.2 million), Garmatex Holdings Ltd. ($5 million), Pure Snax International Inc. ($1.6 million), and Vitality BioPharma Inc. ($17 million).

Co-Conspirators and Legal Fallout

The indictment reveals Roger "Rocket" Knox, the mastermind behind Wintercap SA, as an alleged co-conspirator. Knox, sentenced to three years in prison in October, was granted a year to self-report. The document also identifies Richard Targett-Adams and five unnamed co-conspirators.

Two Canadians, Zhiying Yvonne Gasarch and Jackson Friesen, previously found liable for civil securities fraud, worked for Sharp and faced trial in Boston last September.

California Attorney Indicted in $140M Pump-and-Dump

Counsel representing Sexton, Kelln, and Veldhuis in prior proceedings have yet to respond to requests for comment. The government is represented by James R. Drabick of the U.S. Attorney's Office for the District of Massachusetts.

Details about the defense counsel for the defendants were not immediately available.
