Amazon and Seiko Epson have launched a significant legal strike against counterfeiters operating out of Turkey and the United Kingdom. The duo alleges that these sellers have been offering fake Epson printer ink bottles and cartridges via Amazon's platform, in direct violation of their seller agreements and Epson’s intellectual property rights.

Filed in the Western District of Washington, the detailed 43-page complaint highlights the activities of individuals associated with 24 Amazon seller accounts. These accounts have reportedly been instrumental in advertising, importing, and distributing counterfeit Epson products, thus breaching their contract terms with Amazon and misusing Epson’s registered trademarks.

The plaintiffs point out that the fraudulent scheme spanned from August 2021 to January 2024, during which the defendants colluded to market and sell the counterfeit items. According to Amazon and Epson, these actions not only violated intellectual property laws but also undermined the trust and safety of the Amazon shopping environment.

To combat such fraud, Amazon has ramped up its protective measures. The company's Brand Registry and Project Zero initiatives have been pivotal in shielding brands and rights. In fact, in the past year alone, Amazon thwarted over 700,000 attempts by rogue sellers to establish selling accounts, preventing any counterfeit listings from occurring.

Epson’s internal investigations, which included multiple test purchases from the accused sellers, confirmed the counterfeit nature of the products. The counterfeit items specified in the lawsuit include products like the Epson T522 EcoTank Ink and the Epson 502 EcoTank Color Combo Pack.

Ongoing Vigilance and Litigation

This lawsuit is the latest in a series of actions Amazon has undertaken with various partners to address and curb the sale of counterfeit goods on its platform. Similar collaborative lawsuits have been initiated with brands like Nintendo, Procter & Gamble, and Salvatore Ferragamo, each aiming to protect the authenticity of products sold online.
