[OAKLAND, CA] 3:34 PM PST – With the holiday shopping season upon us, California shoppers are being asked to keep more than just gift lists in mind. As of January 1, AB 1084 is the law of the land, requiring large retailers to establish gender-neutral sections for children’s toys and childcare items. Attorney General Rob Bonta has issued a press release, encouraging consumers to report non-compliant stores.

The law targets retail chains with 500 or more employees statewide. It demands that a “reasonable selection” of children’s items be displayed in gender-neutral sections—spaces that, by design, challenge traditional marketing norms. Retailers who fail to comply face fines of up to $250 for a first violation and $500 for subsequent offenses.

While this might seem straightforward, the reaction from consumers and businesses has been anything but.

“By requiring large retailers to maintain a gender-neutral section, AB 1084 makes it more difficult for these retailers to engage in gender-based pricing discrimination and reduces the imposition of gender stereotypes on children,” said Bonta in his press release.

Shoppers or Store Spies?

What makes this law particularly controversial is the enforcement mechanism. Shoppers are encouraged to document and report violations by taking photos and filing complaints online. This reliance on consumer reporting has led some critics to label the law as overly intrusive.

“Asking holiday shoppers to spy on stores is peak authoritarian absurdity,” argued one detractor, calling out what they see as misplaced priorities in California’s legal system. “Thieves get a pass, but businesses are punished for not being woke enough.”

On the flip side, proponents argue that such measures are necessary to hold corporations accountable. They point to the positive ripple effects of removing gendered stereotypes, emphasizing how small changes can influence societal norms over time.

The Broader Context

This law isn’t just about toys and gender roles. It’s part of a broader push to reshape how businesses operate, especially in an era when consumer expectations and legal obligations are evolving. For example, Senate Bill 478, effective since July, bans misleading price advertisements that exclude hidden fees.

The stakes are high for retailers: compliance with these laws is now a baseline expectation. But critics warn that too many regulations could deter businesses from operating in California altogether.
