In a dramatic turn of events, Oracle America has agreed to pay a staggering $15.5 million to settle a long-standing legal battle with more than 5,000 current and former sales representatives. The settlement, which comes after nearly a decade of legal wrangling, marks a major step toward resolving a lawsuit filed in California state court. The case, initiated under the Private Attorneys General Act (PAGA), accuses Oracle of illegal wage practices, including delayed commission payments and other labor law violations.

The Origin of the Battle: A Decade of Disputes

The lawsuit, first filed in San Mateo County Superior Court by former Oracle sales representatives Maryam Abrishamcar and Kavi Kapur, has been a protracted battle since 2015. The plaintiffs accused Oracle of violating California labor laws, claiming that the company failed to provide timely signed commission contracts, imposed unlawful deductions from commissions, and forced workers into illegal confidentiality agreements.

The case gained momentum over the years, culminating in a settlement agreement announced on Wednesday. While Oracle agreed to a large sum to end the dispute, the company has denied any wrongdoing, with the settlement stating, "Neither the fact of the agreement nor anything in this agreement is intended or should be construed as an admission by defendant that any of the allegations by the plaintiffs have merit or that defendant has any liability for any claims asserted."

The Terms of the Settlement: Where the Money Goes

Under the terms of the settlement, the total amount of $15.5 million will be divided as follows:

• $8.61 million in PAGA penalties, of which 75% ($6.46 million) will go to the California Labor & Workforce Development Agency.

• The remaining 25% will be distributed to the affected workers.

Plaintiffs’ legal team plans to seek 40% of the total settlement amount, equating to $6.2 million, plus up to $565,000 in expenses. Additionally, two named plaintiffs, Abrishamcar and Kapur, are set to receive PAGA representative awards of $65,000 and $45,000, respectively.

A Hard-Fought Victory After Years of Legal Battles

The legal journey to this point has been nothing short of turbulent. Oracle initially tried to strike the complaint in 2015, but the plaintiffs fought back, adding additional claims and expanding the case. After securing partial summary judgment in their favor in 2018, the plaintiffs faced years of court battles, including two trials and motions to arbitrate the case.

In 2022, a California Court of Appeal ruling opened the door for Oracle to push for arbitration of individual claims, leading to further delays and negotiations. However, in December 2024, a breakthrough occurred when both sides engaged in mediation. The settlement came after months of back-and-forth, culminating in an agreement that would finally put an end to this protracted dispute.

Legal Experts Weigh In

Plaintiffs' attorney Michael Palmer from Sanford Heisler Sharp McKnight LLP expressed his satisfaction with the settlement, calling it a "compromise and settlement of highly disputed claims" that finally closes the chapter on years of litigation. He noted, "We are extremely pleased by this settlement, which brings to conclusion nearly a decade of litigation."

Co-counsel Xinying Valerian of Valerian Law PC added, "This settlement is a testament to the dedication of our clients who have invested years of their lives to achieving this outcome." Meanwhile, Laura Ho, another co-counsel, emphasized the importance of the plaintiffs' actions in enforcing California's labor laws, saying, "This settlement shows the importance of these two former employees stepping forward."

Oracle’s Response: No Comment Yet

Representatives from Oracle have not yet responded to requests for comment, but the settlement signifies a significant resolution to what has been one of the most talked-about labor disputes in the tech industry in recent years.

The settlement will compensate those affected from two specific class periods: July 24, 2014, to Sept. 18, 2015, and Oct. 30, 2016, to Feb. 9, 2018. It includes up to 5,167 workers who were subjected to the company’s incentive compensation plan or similar agreements.

This saga, which began in 2015, has now come to a close, with Oracle agreeing to pay $15.5 million to resolve the case — a hefty price to pay for a company with billions in revenue, but a small price compared to the damage done over nearly a decade of legal drama.
