In a developing scandal that’s sending shockwaves through Capitol Hill, a bombshell ethics complaint has been filed against U.S. Senator Adam Schiff (D-CA) accusing him of a pattern of mortgage fraud, voter fraud, and unlawful campaign filings stretching back over two decades.

Initially filed October 16, 2024, by Christine Bish and Darren Ellis, the complaint demands urgent action by the U.S. House Committees on Ethics, Oversight, and Judiciary—and echoes growing calls for a formal criminal investigation by the Department of Justice and FBI.

According to the 20-page document, Schiff may have violated Maryland Code §7-401 and California’s Election and Tax Codes, including statutes that mirror the allegations recently leveled against New York Attorney General Letitia James—particularly in the realms of mortgage and insurance fraud.

According to the complaint, “In 2009, Adam Schiff’s residence and voting registration was called to question in a House Ethics Committee hearing. Adam Schiff, despite claiming to live and represent the people in the state of California, filed and reaffirmed through refinancing documents, his primary residence at 8204 Windsor View Terrace, Potomac Maryland, 28054.”

The complaint further alleges, “Adam Schiff is on the record having acknowledged the mortgage document filings [of Maryland as his primary residence] during a House Ethics hearing in 2009… He made the claim of ‘mistake,’ thereby acknowledging the appearance of possible mortgage fraud.”

But the complaint doesn't stop there. It outlines a disturbing pattern of what Maryland law defines as a “pattern of mortgage fraud,” involving repeated false representations of Schiff’s primary residence across multiple properties and years. Under Maryland Code §7-407(c), such conduct could constitute a felony punishable by up to 20 years imprisonment or a $100,000 fine—or both.

The Maryland-California Residence Ruse?

The central claim is that Schiff claimed California residency while allegedly living primarily in Maryland. In 2003, Schiff and his wife sold their California home and purchased a Maryland property, affirming it was their “Primary Residence” in official mortgage documents. Yet, one month later, Schiff re-registered to vote in California at a 700 sq. ft. one-bedroom apartment in Burbank—an unlikely domicile for a family with two school-aged children.

In 2009, Schiff was hit with an ethics complaint regarding this very matter. He admitted to submitting inaccurate information on mortgage documents, attributing it to a “mistake”—a claim now reignited with new vigor.

But over the following years, Schiff refinanced his Maryland home three more times—each time affirming it as his “Primary Residence.”

The complaint alleges, “In 2010, 2011, and 2013, Adam and Eve Schiff refinanced the Maryland home… all three times reaffirming their ‘Primary Residence’ at 8204 Windsor View Terrace, Potomac Maryland, 28054.”

This series of transactions, if proven fraudulent, satisfies Maryland’s legal definition of a “pattern of mortgage fraud,” as it involves multiple properties, repeated falsehoods, and financial gain.

Voter Fraud and Election Law Violations?

The complaint takes a darker turn when addressing Schiff’s political legitimacy. The document cites California Election Code §2022 and §349, which define a voter’s residence and domicile requirements, especially for congressional candidates. In essence, a candidate must reside in the state they represent—a requirement Schiff may have violated.

That timeline matters: Schiff ran for re-election in 2004, 2006, and 2008—all while, according to public records, residing in Maryland. California Election Code §18203 imposes criminal penalties for knowingly submitting false candidacy declarations, and §18560 defines fraudulent voting as a felony punishable by up to three years’ imprisonment.

A Federal Seat in Jeopardy?

If proven true, these allegations threaten the very legitimacy of Schiff’s current Senate run. Article I, Section 3, Clause 3 of the U.S. Constitution clearly states that a U.S. Senator must be “an inhabitant of that State for which he shall be chosen.”

According to the complaint, “Adam Schiff has maintained his place of primary residency… in Potomac, Maryland. His continued claim of primary residence in Maryland reasonably negates California’s residency requirements.”

Even under California’s tax laws, Schiff may have exposed himself to liability. California’s Franchise Tax Board prohibits individuals from claiming residency in another state while actually living in California—raising questions about potential state income tax evasion or misreporting.

Echoes of Letitia James

Legal experts note chilling parallels between Schiff’s alleged conduct and the ethics and fraud allegations haunting New York Attorney General Letitia James. Like James, Schiff is accused of fraudulent property declarations and using political office while misrepresenting personal financial interests.

“This complaint presents an alarming pattern of misconduct that cannot be ignored,” said a California election law expert familiar with the matter. “The same types of offenses—mortgage fraud, fraudulent filings, tax discrepancies—are showing up in complaints against high-ranking officials from coast to coast.”

Public Calls for Criminal Charges Mount

With this complaint now submitted to Congress, the heat is on for the DOJ and FBI to act. Many voters, watchdog groups, and even political opponents have begun openly calling for a criminal referral and full-blown investigation into Schiff’s alleged misconduct.
