“LASIK Took Everything From Me”: Family of Late Penn Hills Officer Sues LasikPlus, Alleging Informed-Consent Failures

PITTSBURGH — The death of Penn Hills police officer Ryan Kingerski has now become the center of a potentially consequential legal battle over one of America’s most widely marketed elective medical procedures.

Kingerski, 26, died by suicide in January 2025 after what his family describes as months of severe, life-altering symptoms following LASIK eye surgery. His parents have filed suit against LasikPlus and the physician who performed the procedure, alleging their son was not adequately advised about the procedure’s risks or safer alternatives before agreeing to surgery.

At the heart of the lawsuit is not merely whether Kingerski experienced a poor outcome. It is whether the information he received beforehand was enough to allow him to make a legally informed decision about an irreversible elective procedure.

According to reporting by CBS Pittsburgh, Kingerski’s family says he developed debilitating headaches, floaters, dark spots, double vision, blurry vision and difficulty focusing after the surgery. His father, Timothy Kingerski, said his son left a note stating: “I can’t take this anymore. LASIK took everything from me.”

The family’s allegations have not been proven in court. But they raise a question that reaches far beyond one clinic or one patient: when an elective procedure is promoted as quick, routine and successful for most people, how much detail must a provider give a patient about the minority of cases involving severe or persistent complications?

LasikPlus previously declined to discuss the particulars of Kingerski’s case, citing legal restrictions on patient-specific information. The company said patients receive informed-consent documentation before their procedure addressing recognized risks, benefits and alternatives, and maintained that there is no clinical evidence linking suicide to LASIK eye surgery.

That defense sets up the central legal battlefield.

Under Pennsylvania’s Medical Care Availability and Reduction of Error Act, informed consent for surgery requires that a patient receive a description of the procedure, along with the risks and alternatives a reasonably prudent patient would need to make an informed decision. The statute also requires expert testimony to identify the relevant risks and alternatives, and requires a plaintiff to show that receiving the missing information would have been a substantial factor in the decision to undergo the procedure.

In other words, a signed consent form may be important evidence, but it is not necessarily the end of the inquiry. The legal question is whether the consent process meaningfully conveyed the information a reasonable patient would consider material before proceeding with surgery.

That distinction matters in Kingerski’s case because the family alleges he was not properly told about safer alternatives or the possible risks that could follow LASIK. The available reporting does not identify every specific alternative the family contends should have been disclosed, nor does it detail all claims or damages sought in the complaint. Those issues will likely become clearer as the litigation moves forward and the parties present expert evidence.

The broader medical data surrounding LASIK is also more complicated than either side’s simplest talking point.

The American Refractive Surgery Council states that serious, sight-threatening LASIK complications occur in fewer than 1% of cases, while reporting high rates of visual improvement and patient satisfaction overall.

At the same time, the FDA’s LASIK Quality of Life Collaboration Project found that some patients reported new visual symptoms after surgery, including halos, glare, ghosting and dry-eye symptoms. Up to 46% of participants who had no visual symptoms before surgery reported at least one visual symptom three months later, although fewer than 1% reported substantial difficulty performing usual activities because of any one symptom, and more than 95% reported satisfaction with their vision.

Those figures are not necessarily contradictory. They measure different things. A rare rate of sight-threatening complications is not the same as a rate of temporary or persistent visual symptoms, and a high overall satisfaction rate does not erase the devastating reality of patients who fall into the smaller group with severe outcomes.

The FDA itself advises prospective LASIK patients to understand the limitations of the procedure, including the possibility of undercorrection, overcorrection, chronic dry eye, glare, halos, night-driving difficulty, visual changes and, in some cases, permanent loss of vision. The agency also stresses that candidates should review the informed-consent materials, ask questions and understand when to seek medical help after surgery.

For the Kingerski family, those warnings now form part of a larger allegation: that their son made an irreversible decision without being given enough information to understand the potential consequences.

The case will also confront the difficult issue of causation. LasikPlus has emphasized that suicide cannot be reduced to a single cause. The family, however, contends that Kingerski’s suffering and loss of function after surgery fundamentally changed his life. A court will ultimately have to evaluate the medical evidence, expert testimony, treatment records and the precise disclosures made before the procedure—not merely the competing narratives now appearing in public.

What cannot be disputed is that Kingerski’s death has transformed a private tragedy into a public reckoning over patient autonomy, risk disclosure and the business of elective vision correction.

LASIK may be highly successful for most patients. But this lawsuit asks whether “most” is enough when the consequences for the patients who suffer worst-case outcomes may be permanent, disabling and, as Kingerski’s family alleges, unbearable.
