Starbucks Sued Over ‘Sugar-Free’ Protein Drinks That Contain Up to 21 Grams of Sugar

  • Starbucks is accused of calling eight protein drinks “Sugar-Free” even though some servings allegedly contain 13 to 21 grams of naturally occurring sugar.

A new lawsuit against Starbucks may come down to two phrases that sound almost interchangeable at the coffee counter but carry very different meanings under federal law — “sugar-free” and “no added sugar.”

Three consumers filed the proposed class action on October 2 in the U.S. District Court for the Western District of Washington. The case, Walsh et al. v. Starbucks Corporation, No. 2:26-cv-03745, challenges eight hot and iced vanilla and caramel protein lattes and matchas sold under names containing the words “Sugar-Free.” 

The plaintiffs say those names give customers a straightforward message: the finished drink is essentially free of sugar. But according to the lawsuit, venti versions contain roughly 13 to 21 grams of sugar, largely from lactose naturally present in milk.

That distinction matters because federal regulations do not treat sugar-free as casual marketing language. FDA rules generally require a food making that claim to contain less than 0.5 grams of sugar per reference amount customarily consumed and per serving, along with additional requirements concerning calories and disclosures. “No added sugar,” meanwhile, is a separate claim aimed at whether sugars were added during processing. Legal Information Institute

And that is where this case gets unusually interesting.

Starbucks is not concealing the total sugar figures deep inside some unavailable document. Its own website identifies the hot Sugar-Free Vanilla Protein Latte as having 15 grams of sugar and 230 calories in a grande, while simultaneously describing it as having “No Added Sugar.” The company's hot Sugar-Free Caramel Protein Matcha lists 16 grams of total sugar in a grande. Starbucks

So this is not simply a lawsuit accusing Starbucks of hiding nutrition information. The tougher question is whether Starbucks can prominently place “Sugar-Free” in the name of the finished beverage and then rely on nutrition disclosures explaining that the drink actually contains sugar.

The plaintiffs say it cannot.

Starbucks says the lawsuit has no merit. The company maintains that the sugar comes naturally from its protein-boosted milk, that it does not add sugar to the drinks and that the flavoring syrups are sugar-free. Starbucks also says nutritional information has been consistently available through its menus, marketing materials, website and mobile app.

That defense highlights the question a judge may eventually have to confront: Does a detailed nutrition disclosure correct what consumers allegedly understood from the product's name before purchasing it?

The drinks were introduced in September 2025 as Starbucks pushed deeper into protein-focused beverages. Its launch materials promoted protein drinks made with protein-boosted milk and described certain options as having zero added sugar. About Starbucks
