Key Takeaways

  • Former CIA Director John Brennan suffered a significant procedural defeat Thursday when a federal judge dismissed his unusual lawsuit seeking to force the Justice Department and other federal officials to preserve records connected to criminal investigations involving him.
  • U.S. District Judge Jia Cobb concluded Brennan had not shown an imminent injury or established that government officials were actually destroying records, finding his theory too speculative to justify federal-court intervention.
  • The ruling does not end the investigations. Brennan has been subpoenaed in a broader federal grand-jury investigation, while his attorneys say prosecutors have identified him as a target of a separate inquiry examining whether he made false statements to Congress. Brennan denies wrongdoing.

WASHINGTON - Former CIA Director John Brennan's attempt to get ahead of federal investigators ran into a fundamental constitutional obstacle Thursday when a federal judge dismissed his lawsuit seeking an extraordinary court order requiring the Justice Department and other federal agencies to preserve records connected to investigations involving him.

The ruling leaves Brennan without the preemptive judicial protection he sought while the investigations themselves remain alive.

U.S. District Judge Jia Cobb concluded that Brennan had not established the kind of imminent injury necessary to give him standing to obtain forward-looking relief. Brennan's lawyers argued that government communications could eventually become important evidence if Brennan is indicted and seeks dismissal on grounds of selective or vindictive prosecution.

But Brennan has not been indicted.

And that distinction proved critical.

Cobb concluded that Brennan had not demonstrated that DOJ was presently destroying—or would destroy—materials relevant to such a future defense. His claimed injury therefore depended upon a chain of events that may or may not happen: prosecutors would first have to charge him, Brennan would then challenge the prosecution, and potentially relevant government records would have to disappear before they could be obtained.

Even accepting Brennan's allegations as true for purposes of considering the case, Cobb found the alleged injury “too attenuated” to establish standing.

That makes the decision particularly notable because Cobb was nominated to the federal bench by President Joe Biden in 2021. The dismissal therefore cannot easily be characterized simply as a Trump-appointed judge siding with the Trump Justice Department.

Brennan filed Brennan v. Blanche, No. 1:26-cv-02323, in the U.S. District Court for the District of Columbia on July 1. He sued the Justice Department and an unusually broad collection of government officials and entities, seeking preservation of communications and other materials that he believes could someday reveal improper political motivations behind investigations targeting him.

The litigation was essentially a legal preemptive strike.

Instead of waiting to see whether prosecutors actually charge him—and then using the procedural protections available to a criminal defendant—Brennan attempted to obtain judicial intervention while the investigative process was still underway.

His own attorney acknowledged during September arguments that the requested relief was unusual.

Brennan's concern is not entirely theoretical in one important respect: federal investigators are examining his conduct.

His attorneys have disclosed that Brennan has been subpoenaed in connection with a broader Florida grand-jury investigation examining whether former intelligence and law-enforcement officials participated in a conspiracy involving investigations directed at Donald Trump.

Separately, Brennan's lawyers say prosecutors have identified him as a target of an investigation examining whether he made false statements during 2023 testimony before the House Judiciary Committee concerning the intelligence community's assessment of Russian interference in the 2016 election.

No indictment has been returned, and Brennan has denied wrongdoing.

Brennan's lawsuit did present an unusual situation: a former CIA director asking a federal court to intervene against the Justice Department based substantially on what he anticipates prosecutors might eventually do to him.

The court declined.

Brennan's attorneys, Ken Wainstein and Dan Gelber, characterized Thursday's ruling as a decision about standing rather than a rejection of their underlying allegations of political retaliation. They maintain that any future prosecution could be challenged as selective or vindictive.

That argument remains available if Brennan is actually indicted.

But there is another side to the procedural equation that should not be overlooked.

Federal courts generally do not supervise criminal investigations merely because a potential defendant believes investigators are acting improperly. Prosecutors ordinarily investigate first, a grand jury determines whether charges are warranted, and—if an indictment follows—the defendant can then challenge the government's evidence, conduct and constitutional basis for prosecution.

Brennan effectively sought to move part of that fight forward before the government had even filed a criminal case against him.

Judge Cobb refused to do it.

What this case did establish is considerably narrower but still consequential: Brennan could not presently demonstrate the concrete and imminent injury required to enlist a federal court in policing the government's preservation of evidence during an ongoing investigation.

For a former CIA director attempting to position himself in court before prosecutors decide whether to charge him, that is an important legal setback.
