Can Elephants Sue For Freedom? Hawaii Supreme Court To Hear Historic Legal Battle Over Zoo Captivity

What's at Stake for Mari and Vaigai

  • A legal first could emerge:Hawaii's Supreme Court will consider whether two elephants can challenge their captivity through habeas corpus.
  • A fight over legal personhood:The justices must decide whether certain liberty protections can extend beyond human beings.
  • National consequences:A ruling favoring the elephants could open a new path for challenging animal confinement in American courts.

HAWAII, Honolulu - Two elephants living at the Honolulu Zoo are at the center of a legal fight that could force American courts to reconsider a centuries-old question — who, exactly, is entitled to protection against unlawful confinement?

On Monday, November 9, the Hawaii Supreme Court will hear arguments in Nonhuman Rights Project v. City and County of Honolulu, a case brought on behalf of Mari and Vaigai, two Asian elephants whose advocates want them removed from the zoo and transferred to an accredited elephant sanctuary.

The hearing begins at 10 a.m. Hawaii Standard Time, but not inside the Supreme Court's usual courtroom. Instead, the justices will convene at Punahou School in Honolulu, where students and members of the public can observe the proceedings. The arguments will also be livestreamed. Official Hawaii Judiciary hearing schedule.

For USA Herald, the most consequential aspect of this case isn't simply whether elephants belong in zoos. It's whether American law can recognize a limited, enforceable liberty interest in an intelligent animal without granting that animal the full legal status of a human being.

The Nonhuman Rights Project argues that Mari and Vaigai possess sophisticated cognitive abilities, emotional awareness and social relationships that make prolonged captivity an infringement upon their bodily liberty.

Rather than pursuing a traditional animal-cruelty lawsuit, the organization invoked habeas corpus — the centuries-old legal remedy used to challenge unlawful detention.

The organization wants an evidentiary hearing at which the zoo would have to defend the legality of the elephants' confinement. That is different from asking the Supreme Court to immediately order their release.

The legal obstacles are substantial.

On January 28, 2026, Hawaii's Intermediate Court of Appeals affirmed dismissal of the petition, concluding that elephants are not legally recognized as persons under Hawaii Revised Statutes Chapter 660. The appellate court also determined that the statute supersedes the common-law habeas remedy and that the historical writ itself applied only to persons.

The January 28 appellate decision established three separate barriers that the elephants' attorneys must now overcome.

The city's position rests on statutory language and judicial authority. Hawaii Revised Statutes Section 660-3 authorizes habeas relief for persons unlawfully deprived of liberty. Honolulu maintains that extending that protection to animals would require a change in law better suited to the legislature.

There is an important precedent.

In 2022, New York's highest court rejected a similar petition involving Happy, an elephant at the Bronx Zoo. The court held that habeas corpus protects human liberty and does not apply to nonhuman animals.

But the New York decision also demonstrated that judges can disagree over whether recognizing a particular legal right necessarily requires recognizing every right associated with personhood. Read the New York Court of Appeals decision.

USA Herald's review identifies an especially important procedural distinction. Even if Hawaii's Supreme Court allows the elephants' petition to proceed, that would not automatically establish that their confinement is unlawful.

A further hearing could be necessary to examine scientific evidence, captivity conditions, competing welfare considerations and whether sanctuary placement is an appropriate legal remedy.

The justices could also recognize that common-law habeas corpus survives alongside Hawaii's statute while declining to extend it to elephants.

Either outcome would leave the court with a question likely to outlive Mari and Vaigai themselves.

If the law recognizes that animals can suffer from deprivation of liberty, but provides no legal mechanism to challenge that deprivation, does existing animal-welfare legislation offer meaningful protection — or does it address an entirely different legal injury?

Monday's arguments will not settle every dispute over animal rights. They could, however, determine whether future courts must consider those claims rather than dismiss them before the evidence is heard.
