Confidential Sources at Center of Catherine Herridge’s Supreme Court Fight Over $800-a-Day Contempt Fines

Confidential sources are once again at the center of a major legal battle involving former Fox News investigative reporter Catherine Herridge, who is preparing to ask the U.S. Supreme Court to intervene after a federal appeals court declined to halt enforcement of a contempt order that could cost her $800 per day for refusing to identify the source behind one of her investigative reports.

The case has become one of the most closely watched press freedom disputes in recent years, raising important questions about the extent of First Amendment protections for journalists, whether reporters can be compelled to reveal anonymous sources, and how courts should balance those protections against a litigant's right to obtain evidence.

Appeals Court Declines to Pause Contempt Order

On Monday, the U.S. Court of Appeals for the District of Columbia Circuit denied Herridge's request to delay enforcement of its mandate while she prepares a petition asking the Supreme Court to review her case.

The decision represents another setback for the veteran investigative journalist, who has consistently maintained that revealing a confidential source would violate a fundamental principle of investigative journalism and discourage future whistleblowers from coming forward.

Unless higher courts intervene, Herridge could ultimately face civil contempt sanctions of $800 per day until she complies with a court order requiring her to identify the individual who allegedly provided information used in one of her reports.

The fine is intended to coerce compliance rather than serve as criminal punishment.

Battle Began With Confidential Sources Leak Allegations

The dispute stems from a 2017 Fox News investigation involving Chinese-American scientist Yanping Chen, who became the subject of an FBI counterintelligence investigation.

Herridge's reporting discussed Chen's background, including her previous service in China's People's Liberation Army, questions surrounding immigration paperwork, and federal scrutiny involving research connected to China's aerospace program.

Federal agents investigated Chen for approximately six years and searched her home during the inquiry. Despite the lengthy investigation, Chen has consistently denied spying for China and was never criminally charged.

In 2018, Chen sued the FBI, alleging that federal officials improperly leaked confidential investigative information to damage her reputation. After attempting to identify the source through dozens of depositions, Chen's legal team subpoenaed Herridge and Fox News seeking the identity of the government official who allegedly disclosed the information.

Reporter Refuses to Identify Confidential Sources

Herridge has repeatedly refused to answer questions regarding the source during court-ordered depositions.

In February 2024, U.S. District Judge Christopher Cooper found Herridge in civil contempt after concluding that she had failed to comply with discovery orders requiring disclosure.

The judge imposed a daily fine designed to pressure compliance, but Herridge has continued to resist the order while pursuing appeals.

Her attorney, Pat Philbin, has argued throughout the litigation that his client "remains committed to protecting reporters' First Amendment rights and confidential sources."

Fox News Defends Confidential Sources and Freedom of the Press

Fox News has continued to publicly support its former investigative correspondent throughout the legal battle.

Following the appellate court's latest ruling, the network issued a statement criticizing the decision.

"The D.C. Circuit's refusal to pause these crippling fines while a petition is actively being prepared for the United States Supreme Court is deeply troubling," a Fox News spokesperson said.

The company added that forcing journalists to reveal anonymous sources "strikes at the very heart of the First Amendment" and warned that such rulings could discourage future investigative reporting by making confidential informants less willing to speak with reporters.

Fox News also pledged to continue supporting Herridge's efforts to challenge the ruling.

Press Freedom Groups Raise Concerns

Media organizations and press freedom advocates have closely followed the case because its outcome could influence future disputes involving confidential sources.

Following an earlier appellate ruling, the Freedom of the Press Foundation described the decision as "a significant blow to press freedom for all journalists."

Many news organizations argue that investigative reporting often depends on confidential sources willing to expose government misconduct, corporate wrongdoing or public corruption. Without assurances of anonymity, they contend, many whistleblowers would simply remain silent.

Unlike many states that have enacted reporter shield laws protecting journalists from compelled disclosure in certain situations, there is no broad federal shield law that automatically protects confidential sources in civil litigation.

As a result, courts frequently evaluate such disputes individually, weighing constitutional protections against a litigant's need for evidence.

Chen's Attorneys Welcome Confidential Sources Ruling

Attorneys representing Yanping Chen argue that the circumstances of the case justify requiring Herridge to identify her source.

Chen's attorney, Andy Phillips, previously stated that "two federal courts have now agreed that Catherine Herridge has no privilege to continue to shield the identity of a federal official who broke the law and leaked protected materials."

Chen's legal team contends that identifying the alleged leaker is essential to proving her claims against the federal government.

Supreme Court Review Could Shape Future Cases

Herridge is now expected to petition the U.S. Supreme Court, asking the justices to review whether journalists possess constitutional protections that allow them to refuse disclosure of confidential sources in civil cases.

Legal scholars say the case has the potential to become one of the most significant First Amendment disputes involving journalism in decades. A Supreme Court decision could clarify the extent to which reporters may rely on confidential sources while conducting investigations involving government agencies and public officials.

Until then, the case remains closely watched by journalists, media organizations and First Amendment advocates across the country, many of whom believe the outcome could have lasting implications for investigative reporting in the United States.
