“While the lack of a mandatory click or scroll function on the hyperlink weighs in favor of Longobardi’s position, it does not mandate reversal,” the court stated, concluding that Longobardi had been given sufficient opportunity to understand the arbitration terms prior to signing.

Arbitration Outcome and Legal Representation

Before appealing, Longobardi’s case had already been heard by an arbitrator who ruled in Gulfstream’s favor, a decision subsequently upheld by a Hampshire County judge last year. Following the appellate decision, the Superior Court’s judgment enforcing arbitration remains valid.

In its decision, the court concluded, “There was no error by the Superior Court judges who entered orders compelling arbitration and confirming the award, and no error in the entry of judgment consistent with the award.”
