Texas Father Has Filed First-of-Its-Kind Federal Lawsuit Against California Doctor Over Alleged Abortion Pill Deaths

Plaintiff Jerry Rodriguez claims his girlfriend’s estranged husband obtained the abortion pills through a $150 Venmo payment to “Remy Coeytaux MD PC,” labeled cryptically as “Aed axes” – which Rodriguez’s legal team interprets as a phonetic spelling of “Aid Access,” a well-known network that facilitates access to abortion pills.

The lawsuit alleges that Rodriguez’s girlfriend was pressured by her estranged husband to take the pills, resulting in two separate pregnancy terminations. According to court documents, the first abortion occurred in September 2024 at the home of the girlfriend’s mother, while the second took place in January 2025 at her estranged husband’s residence. Ultrasound images attached as evidence purportedly show the second pregnancy involved a boy.

The complaint’s most striking element is its revival of the dormant Comstock Act, an 1873 federal anti-obscenity law that technically prohibits mailing abortion-related materials. Though largely unenforced for over a century, the statute remains federal law under 18 U.S.C. §§ 1461 and 1462.
