Worker, Mercedes-Benz, and Randstad Reach Tentative Overtime Settlement

A Georgia federal court filing revealed that Mercedes-Benz USA LLC and staffing giant Randstad North America Inc. have reached a tentative settlement with a worker who accused them of violating the Fair Labor Standards Act (FLSA) by denying overtime pay.

In a joint notice submitted Thursday, Ciarrah Harrington and the two companies informed the court that they are finalizing formal settlement documents and expect to file an approval motion within the next 30 days. The parties also asked the court to stay the ongoing litigation while they complete the settlement process.

The Overtime Battle

Harrington filed the lawsuit in October 2024, alleging that both Mercedes-Benz and Randstad had willfully failed to pay her overtime wages, despite her routinely working more than 40 hours per week. The suit accused the companies of flouting federal wage laws and exploiting staffing arrangements to sidestep labor obligations.

Her complaint asserted that she was “billable labor” for both companies, performing duties essential to Mercedes-Benz’s operations, but was deprived of the legally required time-and-a-half pay.
