Courthouse Bomber Gets 30 Years

In a legal rollercoaster that has left many bewildered, a California federal judge has sliced the prison time for a man convicted in the infamous 2008 bombing of a San Diego courthouse. The defendant, Donny Love Sr., saw his sentence dramatically reduced from a staggering 34 years to a comparatively shorter 30 years. This shocking twist comes after the Ninth Circuit Court of Appeals sent the case back for resentencing due to a minor procedural hiccup.

Donny Love's Decade-Long Ordeal

Donny Love Sr., a name etched in the annals of notoriety, has spent a grueling decade behind bars. Now, the scales of justice have shifted as he's been handed a new judgment - a 370-month prison term, down from his previous 405-month sentence. This unexpected verdict was delivered by the remarkable U.S. Circuit Judge M. Margaret McKeown of the Ninth Circuit, who, intriguingly, sat by designation in the U.S. District Court for the Southern District of California.

Courthouse Bomber Gets 30 Years : A Desperate Plea for Leniency

Love, now in his twilight years, had made a desperate plea to the court. He sought a significantly reduced sentence of 270 months, which equates to around 22 and a half years. Citing his failing health and his impeccable behavior during his decade-long incarceration, Love presented his case in a memo to the court. His diagnoses include asthma, a seizure disorder, and the grim specter of stage 3 chronic kidney disease.

While Love underscored the fact that no one was physically harmed in the courthouse bombing, prosecutors painted a chilling portrait of his crimes. They depicted how Love masterfully manipulated a "sad cast of characters" into placing pipe bombs, causing a cataclysmic explosion that shattered the doors of a federal courthouse in San Diego.

At the time of the bombing, Love was on the brink of serving a six-year prison sentence for robbery. His sinister plan involved turning his recruits, including a drug addict, an elderly woman, and a victim of an abusive relationship, into FBI informants in exchange for leniency.

The Government's Unyielding Stand

The government, not swayed by Love's plea, staunchly insisted that Judge McKeown impose the same 405-month sentence that Love was already serving. They pointed out how Love's legal maneuvering had kept the case alive long enough to whittle down his original 55-year sentence, which was imposed in 2013. The 55-year sentence had been successively reduced to nearly 34 years before being vacated by the Ninth Circuit earlier this year.

A Tumultuous Legal Odyssey

In an unpublished opinion issued in May, a panel of Ninth Circuit judges unearthed a critical error in the sentencing process. Specifically, Love had been sentenced to an astonishing 285 months for possession of an unregistered firearm, an offense carrying a maximum penalty of 120 months in prison.

Judge McKeown, now at the helm, had a weighty decision to make. She had the option to adjust Love's sentence, considering his involvement in six other counts. These included conspiracy to use a weapon of mass destruction, malicious damage to buildings, aiding and abetting, and witness tampering through corrupt persuasion.

Justice Reclaimed, but not Fully

In compliance with the Ninth Circuit's ruling, Judge McKeown's recent decision mirrors an earlier oral judgment by the district court. It imposes a five-year term of supervised release, replacing the previously stated 10-year term.

In response to Love's request, the judgment also includes a recommendation for the Federal Bureau of Prisons. They are urged to involve Love in a restorative justice program or similar initiatives to address his anger management and substance abuse issues.

Courthouse Bomber Gets 30 Years : Restitution Remains a Bitter Pill

Even in this surprising twist, one aspect remains unchanged - Love's obligation to pay $325,000 in restitution, despite his efforts to reduce this significant financial burden.

According to the Bureau of Prisons' website, Love is currently in custody at the Metropolitan Correction Center in San Diego.

Silent Parties in a Legal Drama

Interestingly, counsel for the government refrained from commenting on the presentencing verdict. Counsel for Love remained elusive and did not immediately respond to inquiries.

The government is represented by Fred A. Sheppard, Shane P. Harrigan, and Mark Rehe of the U.S. Attorney's Office for the Southern District of California. Love is representing himself and is also under the legal guidance of John Balazs from the Law Office of John Balazs.
