Amazon Workers Military Leave Class

Current and former Amazon workers have rallied before a Washington federal court, urging the approval of a class that could encompass an astonishing 15,000 individuals. This vast assembly is poised to spearhead a lawsuit that accuses Amazon of wrongfully demoting or terminating workers who took time off for military service. According to these determined employees, their allegations pivot on Amazon's companywide policies, and they are pushing for justice.

A Pivotal Motion for Class Certification

In a recent legal development, former Amazon worker Yasmine Mahone and the current operations manager, Brandon Tole, have filed a motion for class certification. This motion aims to create a class comprising both past and present Amazon employees who have served or are currently serving in the military. Mahone and Tole have been driving the Uniformed Services Employment and Reemployment Rights Act (USERRA) lawsuit against the e-commerce behemoth, and their cause survived Amazon's attempt to dismiss the suit in April.

"Without class adjudication, the judicial system would be inundated with a deluge of individual claims, all addressing identical issues," Mahone and Tole assert. "Moreover, given the inherent risks and costs of litigation, it is improbable that the potential class members would be willing to tackle this battle on their own."

Mahone and Tole have presented compelling data to the court, revealing that Amazon's records indicate that, since January 2015, a staggering 14,842 Amazon employees have taken military leaves of absence. Shockingly, out of this number, 10,756 individuals no longer work for the company, as disclosed in their filing.

Amazon Workers Military Leave Class : The Quest for Justice Grows

Not stopping at a mere class certification, Mahone and Tole are striving to certify two subclasses. Mahone will represent the class of current and former Amazon employees who were paid hourly, while Tole champions a class consisting of past and present salaried employees.

One remarkable aspect of this legal drama is that there is no evidence suggesting that Mahone and Tole have interests conflicting with those of the class they represent. They are well-suited to serve as representatives, as they will only succeed if the class prevails.

"There is no potential for conflict, as plaintiffs will only succeed if the classes also succeed," Mahone and Tole emphasize. "Plaintiffs are well-informed about the litigation, have and will continue to act in the best interests of the classes, and will participate in the litigation as needed."

Amazon Workers Military Leave Class: From Class Action to Amazon Workers' Struggles

The genesis of this class action lawsuit dates back to Mahone, who was in the employ of Amazon from July to October 2020. Mahone, along with another former worker, Dain Olson, initially filed the proposed class action. However, Olson's claims were excised from the lawsuit in April by U.S. District Judge Marsha J. Pechman. Judge Pechman ruled that Olson had waited too long to file his lawsuit, given that he hadn't worked for Amazon since 2016.

Notably, Judge Pechman had also found that Mahone initially lacked standing. Yet, her perseverance and an amended complaint proved her standing and strengthened her case.

Amazon's Alleged Transgressions

Mahone's ordeal stemmed from Amazon's facility in Bessemer, Alabama. The company allegedly terminated her for taking excessive unpaid time off to fulfill her obligations as a member of the Alabama National Guard. Amazon contended that her dismissal was due to an administrative error and even offered her more than $47,000 in back and front wages. Nevertheless, Mahone maintained that she had requested reinstatement just eight days after her termination but was unjustly rebuffed by the company.

Tole's addition to this legal saga came in January. He commenced his journey with Amazon in June 2017 and is a member of the U.S. Marine Corps Reserve. Tole was part of Amazon Pathways, a four-year program for service members to gain managerial experience before advancing to a general manager position. Despite good performance reviews, upon his return from military service in the fall of 2021, Tole's prospects took a grim turn. He was pulled from consideration for promotion, began receiving negative reviews, and found himself consigned to a night shift, forced to restart his climb for the next promotion. Meanwhile, colleagues who had started with him in the Pathways program, and who hadn't taken leave, moved ahead.

Awaiting a Verdict in an Amazon Saga

As the wheels of justice turn, representatives for the parties involved have yet to comment on these recent developments. However, the proposed class is receiving robust legal support. It is represented by Brian J. Lawler of Pilot Law PC, Gene J. Stonebarger of Stonebarger Law APC, Kevin L. Wilson of Kevin Wilson Law PLLC, and Daniel Kalish of HKM Employment Attorneys LLP.

Amazon, a giant in the e-commerce world, is fortified by the legal expertise of Brian A. Richman, Jason C. Schwartz, and Lauren M. Blas from Gibson Dunn & Crutcher LLP, along with Andrew E. Moriarty, Heather L. Shook, and Shannon McDermott of Perkins Coie LLP.
