In a legal showdown that has fashion enthusiasts and legal pundits on the edge of their seats, the ultrafast fashion juggernaut, Temu, has thrown down the gauntlet, vehemently denying allegations of copyright infringement made by its formidable rival, Shein. This high-stakes battle revolves around thousands of promotional photos displayed on Temu's website, and it's a narrative that's as complex and intriguing as a fast-paced thriller.

Temu's Audacious Defense

In a dazzling display of legal prowess, Temu has come out swinging, acknowledging that, indeed, some of its promotional images bore an uncanny resemblance to those of Shein. However, Temu's audacious defense centers on the claim that they were oblivious to the origins of these images, igniting a cascade of questions and speculations.

"The defendant does not exercise control over what product images are posted by third-party sellers," proclaimed the defense, adding an element of enigma to the situation. Who, then, is responsible for these striking resemblances?

Shein's Resounding Accusations

Shein's September claim, which sent shockwaves throughout the industry, accuses Temu, doing business as Whaleco UK Ltd., of orchestrating a grand illusion. Shein asserts that Temu employed thousands of copyrighted images to mislead customers into thinking they were purchasing Shein's products.

"The infringements are on a vast scale and involve direct copying of the entirety of the Shein photographs," Shein's claim declared, creating a sense of epic proportions in the courtroom.

But the plot thickens. Shein further alleges that Temu manipulated these images in an attempt to cover their tracks. However, Temu has placed the blame squarely on the shoulders of third-party sellers, turning the tables in this gripping legal drama.

Temu and shein Photo Theft : A Web of Complexity

Adding a layer of perplexity to the saga, Temu raises another valid point. The letter from Shein, sent in June, included a staggering 8,036 URLs of purportedly infringing photos. Temu contends that this letter failed to raise alarm bells because the claim that Shein owned the copyrights was, in their words, "untrue."

Moreover, Temu argues that the three-day window given to respond to the letter was wholly unrealistic, making it impossible to delve into its intricate contents.

Temu and shein Photo Theft : Legal Standoff

As the legal standoff reaches its zenith, a central point of contention arises. Temu vehemently asserts that Shein lacked the standing to make these demands at the time of their claim. According to Temu, Shein did not possess an exclusive license from its parent company to use these pictures when the letter was dispatched; this exclusive license was only granted in July, a twist in the tale that adds complexity to the narrative.

"Hence neither of the claimants had standing to bring the claim now advanced ... even now they do not own the copyright in all photographs," Temu asserts, leaving everyone in the courtroom in suspense.

Temu and shein Photo Theft : The U.S. Episode

To further bewilder the audience, Temu unveils its trump card: an episode in the United States. Shein had secured an emergency temporary restraining order against Temu in a U.S. court in July regarding a claim made against Temu the previous year over copyright. However, Temu seeks to dispel any notions of guilt, emphasizing that this was merely a "temporary measure" and far from a conclusive indictment.

In a riveting twist, Temu reveals that it had requested and, indeed, the U.S. court granted, a two-month extension in a preliminary injunction motion. This extension granted them additional time to compile further evidence against Shein, muddying the waters of this sensational legal dispute.

A Never-Ending Feud

This legal battle is the latest installment in a saga of courtroom duels between these fashion titans. In a previous face-off in a Massachusetts federal court, Temu accused Shein of monopolizing the fast-fashion market, raising eyebrows by alleging bullying tactics directed towards Chinese manufacturers.

As the case unfolds, the fashion world remains enthralled, watching closely to see which brand will emerge victorious in this sensational battle for supremacy.

Counsel for both parties remained tight-lipped, adding an aura of mystery to this unfolding drama. The Shein camp is represented by Benet Brandreth KC of 11 South Square, guided by the expertise of Simon Bennett from Fox Williams LLP. Whaleco, representing Temu, is in the capable hands of Charlotte May KC and Henry Edwards from 8 New Square, with the legal prowess of Allen & Overy LLP.
