janice Moore $6M Deal To End ESOP Suit

In a riveting twist worthy of a legal thriller, Janice A. Moore, a former bank manager turned David against the Goliath of the banking world, has asked a Virginia federal court to endorse a staggering $6 million settlement. This marks the end of her lawsuit, a David vs. Goliath battle that accused her former employer, Blue Ridge Bankshares, of robbing retirees blind. The lawsuit alleges that the company siphoned their hard-earned employee stock ownership plan (ESOP) for the bank executives' gain.

In a cinematic turn of events, Moore's settlement motion painted the picture of a long-awaited victory. She described the agreement as a beacon of hope, offering "meaningful recoveries" for the cheated former plan members. This deal not only compensates the victims but also allows the accused Blue Ridge defendants to step away from what Moore describes as a "time-consuming and expensive distraction."

A Tale of Greed and Deception

Moore's story began at Virginia Community Bank, where she dedicated 33 tireless years before resigning in May 2018. Her plot thickened with Blue Ridge's merger with VCB in 2019, a $42.5 million transaction that thrust Moore's claims onto Blue Ridge's shoulders.

In a stunning revelation, the settlement discloses that of the $6 million, $2 million will enrich Moore's attorneys, with Moore herself receiving a $17,500 service award. The rest? It's destined for approximately 119 former VCB employees, wronged and robbed of their rightful ESOP distributions.

The Defendants' Persistent Denial

Despite the overwhelming narrative of financial injustice, the defendants maintain their innocence, steadfast in their denial of any wrongdoing. The story was set to climax at a trial in October, but fate had other plans. A settlement conference in August led to a preliminary agreement, steering the saga towards a resolution rather than a courtroom showdown.

U.S. District Judge Norman K. Moon played a pivotal role in this saga. He denied Blue Ridge's bid for summary judgment in March, affirming Moore's allegations of financial harm. Moore accused the defendants of a devious scheme: inflating stock prices for their enrichment, leading to a windfall of $1.5 million in 2007. This scheme, Moore alleged, left her and others with significantly diminished retirement benefits, while the bank executives lined their pockets.

Moore's representatives, including Zev. H. Antell, have maintained a stoic silence, declining to comment. The defendants' representatives were equally silent, not responding to requests for comments.

As this financial drama draws to a close, Moore stands represented by a league of legal eagles from Butler Curwood PLC, Sanborn Law PLC, Marie Carter PLC, and The Krudys Law Firm PLC. In contrast, the defendants are shielded by the formidable team from Morgan Lewis & Bockius LLP.

Conclusion

Janice Moore's saga is more than a legal battle; it's a story of resilience and justice in the face of corporate greed. It's a tale that will be told and retold, serving as a beacon of hope for many who dare to challenge the giants of the financial world.
