Alaska Refinery Leak Liability Fight

In a riveting turn of events, the U.S. Supreme Court has opted not to review a groundbreaking ruling by the Alaska high court. The ruling, made in May, asserted that Williams Alaska Petroleum Inc., the erstwhile owner of an oil refinery in North Pole, Alaska, could be held accountable for potential fines and civil penalties arising from a chemical leak that contaminated nearby groundwater.

Alaska Refinery Leak Liability Fight: The Hazardous Substance Dilemma

Williams Alaska Petroleum had sought a reversal of the state high court's decision, arguing that it contradicted due process precedent. The former owner contended that it could not be held liable under state law for the release of a hazardous substance, specifically the solvent sulfolane. Intriguingly, the environmental regulator did not classify sulfolane as hazardous until after the refinery changed hands.

Unveiling the Controversy

The heart of the dispute lies in whether Williams Alaska Petroleum was given fair notice about the hazardous nature of sulfolane. The company asserts it was aware of the contamination and alerted state officials, but the regulatory acknowledgment came post-refinery sale in 2004 to Flint Hills Resources Alaska LLC.

Alaska Refinery Leak Liability Fight : Allegations of Unjust Burden

Williams Alaska Petroleum further claimed an unjust financial burden, arguing it was unfairly saddled with a hefty $72 million bill for the expansion of North Pole's drinking water system. This expansion was part of a settlement between Flint Hills and the state to counteract the contaminated groundwater. The former owner contends that this cost constitutes a government taking, adding another layer of complexity to the legal skirmish.

"The decision below flies in the face of the fundamental principles of due process with which a state must comply before imposing severe civil liability on a regulated party," remarked Williams Alaska Petroleum in its petition.

State Court Battle and Fallout

Alaska initiated legal proceedings against Flint Hills Resources in 2014, alleging liability for cleanup efforts and damages linked to sulfolane release. Astonishingly, the state also held Williams Alaska Petroleum jointly liable for the same damages, setting the stage for a courtroom showdown.

Following a bench trial, a state court judge ruled that Williams Alaska Petroleum was strictly liable for the sulfolane release, ordering the company to foot 75% of cleanup costs and the city's drinking water system expansion expenses. The judge's decision rested on sulfolane being deemed an "imminent and substantial danger" to public health, irrespective of Alaska's delayed classification as a hazardous substance.

Alaska Supreme Court's Verdict

The Alaska Supreme Court upheld the state court's findings and ruling, cementing the legal quagmire. In its November response urging the U.S. Supreme Court to reject the petition, Alaska contended that fair notice wasn't at play, as Williams Alaska Petroleum was aware of the unlawfulness of sulfolane release.

"This is thus not a case of 'retroactive' liability for conduct believed to be legal at the time," argued the state, countering claims of potential 'taking' of property.

Alaska Refinery Leak Liability Fight : Flint Hills' Perspective

Flint Hills Resources also urged the U.S. Supreme Court to dismiss the petition, emphasizing the case's adherence to established legal principles. "Nothing more than the application of settled principles of law to the unique facts before the Alaska state courts," said Flint Hills.

Alaska Refinery Leak Liability Fight : Legal Representation

Williams Alaska Petroleum is staunchly represented by a legal team from Paul Weiss Rifkind Wharton & Garrison LLP and Shook Hardy & Bacon LLP. Alaska's interests are safeguarded by attorneys from the Alaska Department of Law, while Flint Hills Resources is represented by Jones Day and Ciresi Conlin LLP.

In a legal showdown of epic proportions, the fate of Alaska's environmental responsibility and corporate liability hangs in the balance as the U.S. Supreme Court abstains from intervening in the Alaska Refinery Leak Liability Fight.
