Citigroup Hit With $1B Fraud Lawsuit Revival Over Mexican Oil Scandal

Citigroup must face $1 billion lawsuit

In a stunning legal twist, Citigroup must face a $1 billion lawsuit accusing the Wall Street titan of playing a central role in a massive fraud scheme tied to a now-defunct Mexican oil services company. The decision, handed down Thursday by a three-judge panel from the 11th U.S. Circuit Court of Appeals, revives a long-dormant legal powder keg that could send tremors through the global banking world.

Alleged Cover-Up, Billion-Dollar Losses, and Fraudulent Signatures

At the heart of the revived suit are claims that Citigroup’s Banamex unit enabled and concealed rampant fraud at Oceanografía, a drilling contractor for Mexico's state oil firm, Pemex. Plaintiffs—ranging from bondholders and leasing firms to international creditors—allege that Citigroup knowingly funneled $3.3 billion to Oceanografía between 2008 and 2014, despite glaring red flags including forged Pemex signatures and ballooning debt.

The appeals court determined that the plaintiffs presented a compelling case that Citigroup substantially aided the fraud and withheld critical information that could have prevented more than $1 billion in damages.

A Legal Revival That Could Explode

The case was initially dismissed in 2023 by U.S. District Judge Darrin Gayles, but the 82-page opinion written by Circuit Judge Britt Grant reverses that decision, citing the "sufficiently detailed" allegations. Judge Grant didn’t mince words in the ruling:

“Citigroup is one of the world’s most sophisticated financial institutions, and it strains credulity to conclude that, assuming the plaintiffs’ allegations are true, Citigroup lacked awareness of Oceanografía’s activities.”

In other words, the court found it implausible that a financial juggernaut of Citigroup’s caliber could be duped—suggesting complicity instead of negligence.

The Fallout: Fired Execs, SEC Fines, and a Cloud Over Citigroup

This isn’t Citigroup’s first bruise in the Oceanografía debacle. After uncovering $430 million in fake cash advances, the bank fired 12 employees, while Mexican authorities pointed the finger at 10 others for criminal violations. In 2018, the SEC fined Citigroup $4.75 million for failures in Banamex’s internal controls.

The legal rebuke now sets the stage for a full-blown trial unless a settlement is reached. Plaintiffs, including Rabobank and several investment funds, say they’re ready to fight.

“My clients are gratified by the court’s decision,” said Juan Morillo, a lawyer representing the plaintiffs.

Meanwhile, Citigroup has chosen silence. Spokeswoman Danielle Romero-Apsilos declined to comment.

What’s Next?

The case now heads back to Judge Gayles in Miami, who will oversee the proceedings moving forward. With the potential for massive discovery, testimony from top executives, and global media scrutiny, this lawsuit could be Citigroup’s next major reckoning.

In an era when banks are under increasing pressure to demonstrate ethical conduct and rigorous oversight, this ruling serves as a warning shot—a reminder that even financial giants can be dragged back into the courtroom spotlight when their past deals come back to haunt them.
