Pennsylvania Teachers $165K Equal Pay Suit

In a resounding rebuke of pay inequity, a federal jury in Pennsylvania awarded $165,000 in damages Thursday to two female teachers who claimed the Central Bucks School District shortchanged them compared to male colleagues with similar experience and duties.

After a four-day trial, jurors handed $81,000 to Rebecca Cartee-Haring and $84,000 to Dawn Marinello, marking a major win in a drawn-out legal saga that began in 2020. The teachers accused the district of violating the Equal Pay Act by crediting male educators with more years of experience, resulting in higher salaries.

A Retrial Brings Justice After a Hung Jury

This verdict comes on the heels of a mistrial declared in July, when a previous jury couldn’t reach a consensus. Initially filed as a collective action, the case was decertified in August, leaving Cartee-Haring and Marinello to forge ahead solo.

Their lawsuit claimed systemic flaws in how the district calculated years of service — an approach they argued led to men being unfairly elevated on the pay scale.

Behind the Scenes: A Courtroom Drama of Disqualification and Denials

Adding a twist worthy of a courtroom drama, the district's original legal team from Cozen O’Connor was disqualified just weeks before the first trial. U.S. District Judge Michael M. Baylson, with longstanding ties to the firm, chose not to recuse himself, prompting a reshuffle in the district’s legal defense.

Meanwhile, not all of Cartee-Haring's claims survived. The court dismissed her accusations under Title VII, the Age Discrimination in Employment Act, and the Americans with Disabilities Act concerning her termination as a lacrosse coach. Her Equal Pay Act claim, however, remained intact and ultimately led to Thursday’s verdict.

Comparators and Compensation: The Battle Over Pay Standards

One critical hurdle for the plaintiffs was the court's demand to pinpoint specific male comparators—male teachers who held equivalent roles and responsibilities. The school district pushed back, asserting that the selected comparators differed in job duties or required credentials, thereby justifying the pay gap.

Still, the jury found the evidence compelling enough to side with the women — a decision that could ripple through similar lawsuits challenging public sector compensation policies.

Legal Teams and Final Notes

Cartee-Haring and Marinello were represented by Edward S. Mazurek of the Mazurek Law Firm LLC. The school district’s defense was led by Michael I. Levin, David W. Brown, and Anthony Petro of Levin Legal Group PC.

The verdict, though not monumental in financial terms, sends a clear signal: gender-based pay disparities in public education will face growing legal scrutiny and accountability.
