Nike Shoe Surgeon Settle TM Suit

In a dramatic legal twist that could reshape the sneaker customization landscape, Nike and Los Angeles-based The Shoe Surgeon have reached a settlement in a contentious trademark lawsuit that pitted the sportswear titan against one of its former collaborators-turned-foes.

The settlement, filed Wednesday in Manhattan federal court, resolves Nike’s sweeping seven-claim suit against The Shoe Surgeon (real name Dominic Ciambrone) and his business partner Dallas Imbimbo. The agreement includes a consent judgment in Nike’s favor and a confidential payment by the defendants, closing the book on a fiery $60 million legal saga.

From Collaboration to Confrontation

Nike once embraced The Shoe Surgeon’s artistic sneaker remixes, partnering on more than a dozen projects for celebrities like LeBron James and Usher. But the harmony unraveled in 2024, when Nike sued for federal and state trademark infringement, dilution, unfair competition, and contributory infringement.

According to Nike, the artistry turned rogue: The Shoe Surgeon was allegedly building unauthorized Nike replicas from scratch and branding them deceptively. The complaint also claimed Ciambrone and his team taught others how to produce counterfeit Nike sneakers, fanning the flames of unauthorized reproduction under the guise of art.

Art or Infringement? The Line Blurs

The Shoe Surgeon fired back with counterclaims accusing Nike of defamation and unjust enrichment, arguing that their works were modifications of genuine Nike shoes, not illegal replicas. Their legal team asserted the transformations amounted to personal artistic expression—not trademark abuse.

Nike, however, claimed the defendants leveraged past partnerships to cloak their new creations in false legitimacy, misleading consumers into thinking the customs were sanctioned.

Consent Judgment and Conduct Restrictions

As part of the settlement, the defendants acknowledged their conduct violated the Lanham Act and constituted common-law trademark infringement. They also conceded their actions amounted to unfair competition or civil counterfeiting, while expressly denying any criminal wrongdoing.

The deal imposes clear restrictions: Ciambrone and his team must cease creating any customized Nike sneakers or engaging in activities that could cause brand confusion. However, a limited exception allows for the creation of "one of one" noncommercial, personal-use pieces, under strict disclaimers disassociating the work from Nike.

Fees and Fallout

Both sides agreed to shoulder their own legal fees, signaling an end to what had become one of the most closely watched branding battles in the footwear industry.

Nike was represented by Tamar Y. Duvdevani, Marc E. Miller, Joshua Schwartzman, and Kristina Fernandez Mabrie of DLA Piper.

The Shoe Surgeon and co-defendants were represented by Meredith L. Williams and Michael D. Adams of Rutan & Tucker LLP, Michael R. Yellin of Cole Schotz PC, and Zakari Adam Kurtz of Sneaker Law Firm PLLC.

What It Means for the Sneaker World

The case marks a watershed moment for custom sneaker artists, raising serious questions about the intersection of intellectual property, brand loyalty, and artistic freedom. While the verdict didn’t land with a gavel’s slam, the quiet consent judgment echoes loudly through the streets of fashion and fandom alike.
