The deadly fireworks explosion that rocked Esparto on July 1 has now spawned its first lawsuit, as agricultural victims seek accountability from the companies and individuals they claim ignored fundamental safety protocols. The legal action signals the beginning of what could become extensive civil litigation stemming from a tragedy that claimed seven lives and devastated the surrounding community.

Etta James Farming LLC filed the lawsuit last week in Yolo County Superior court, targeting a network of defendants connected to the fireworks operation that ended in catastrophe.

The Defendants Named in Legal Action

The lawsuit casts a wide net, naming Kenneth Chee, owner of Devastating Pyrotechnics LLC, as a primary defendant. Craig Cutright, who served as an operator for Devastating Pyrotechnics while running his own company Blackstar Fireworks, also faces legal action. In an unusual twist, Sam Machado, a lieutenant for the Yolo County Sheriff's Office who owned the property where the explosion occurred, is included among the defendants.

The corporate entities Devastating Pyrotechnics Inc., Devastating Pyrotechnics LLC, and Blackstar Fireworks complete the list of defendants, creating a complex web of individual and corporate liability that attorneys will need to untangle as the case proceeds.

The central allegation revolves around the defendants' alleged failure to comply with basic safety standards—a claim that takes on devastating significance given the human toll of the explosion. While this marks the first civil lawsuit filed in connection with the tragedy, it likely won't be the last.

The family members of victims Jesus and Jhony Ramos are also considering civil action, according to their legal representative. This suggests additional lawsuits may follow as families and affected parties seek justice and compensation for their losses.

The legal implications extend beyond civil court. Last week, the Yolo County Board of Supervisors escalated the matter by requesting California Attorney General Rob Bonta's assistance, asking the Department of Justice to help lead the investigation into the explosion. This move indicates the potential for criminal charges depending on what investigators uncover.

State Response and License Suspensions

State Fire Marshal Daniel Berlant confirmed Monday that his office has been working closely with the district attorney on the ongoing investigation.

"Obviously, if there is a crime out of this case, we'll turn over to [the district attorney] to prosecute, but in this request, we'll continue to see whether the attorney general decides to step in and be actual prosecuting entity,"Berlant said.

The investigation has already yielded concrete regulatory action. Berlant noted that investigators discovered sufficient red flags to suspend the state licenses for both Kenneth Chee and Craig Cutright last week. These suspensions effectively prohibit them from importing, exporting, selling, or conducting fireworks shows while the investigation continues.

The suspensions represent a significant escalation in regulatory response, suggesting investigators have uncovered serious safety violations or procedural failures. Within 30 days, the fire marshal's office will determine whether sufficient evidence exists to permanently revoke those licenses—a decision that could effectively end both men's careers in the pyrotechnics industry.

Safety Standards Under Scrutiny

Berlant emphasized that when proper safety protocols are followed, explosions of this magnitude simply don't occur. His statement highlights the preventable nature of the tragedy and suggests that adherence to established safety standards could have saved seven lives.

"You can store pyrotechnics in a C container, but it requires a longer spacing between each other, homes, other critical infrastructure like major roadways or railroads," Berlant explained.

This technical detail reveals a crucial aspect of fireworks safety—proper storage and spacing requirements that exist specifically to prevent the kind of catastrophic explosion that occurred in Esparto. The statement implies that these spacing requirements may not have been followed, creating the conditions for disaster.

For Etta James Farming LLC, the explosion represents not just a tragic loss of life in their community, but a direct assault on their livelihood. The destruction of 74 acres of crops during growing season translates to immediate revenue loss and potential long-term financial impact.
