A Texas father has launched what legal experts are calling a landmark federal assault on interstate abortion services, filing a wrongful death lawsuit that revives a 150-year-old federal statute and challenges the boundaries of post-Dobbs reproductive rights litigation.

The case, Rodriguez v. Coeytaux, filed July 20 in the Southern District of Texas, accuses California physician Dr. Remy Coeytaux of "murdering" two unborn children by mailing abortion-inducing drugs across state lines to Galveston County, Texas, where they were allegedly used to terminate pregnancies in September 2024 and January 2025.

Plaintiff Jerry Rodriguez claims his girlfriend's estranged husband obtained the abortion pills through a $150 Venmo payment to "Remy Coeytaux MD PC," labeled cryptically as "Aed axes" – which Rodriguez's legal team interprets as a phonetic spelling of "Aid Access," a well-known network that facilitates access to abortion pills.

The lawsuit alleges that Rodriguez's girlfriend was pressured by her estranged husband to take the pills, resulting in two separate pregnancy terminations. According to court documents, the first abortion occurred in September 2024 at the home of the girlfriend's mother, while the second took place in January 2025 at her estranged husband's residence. Ultrasound images attached as evidence purportedly show the second pregnancy involved a boy.

Legal Strategy Targets Federal Comstock Act

The complaint's most striking element is its revival of the dormant Comstock Act, an 1873 federal anti-obscenity law that technically prohibits mailing abortion-related materials. Though largely unenforced for over a century, the statute remains federal law under 18 U.S.C. §§ 1461 and 1462.

Jonathan Mitchell, the architect behind Texas's controversial SB8 heartbeat law, represents Rodriguez in this latest legal offensive. Mitchell argues that Dr. Coeytaux violated federal law by knowingly using mail services to transport abortion-inducing drugs from California to Texas, regardless of California's legal protections for such activities.

The lawsuit also invokes Texas Penal Code § 19.02, alleging felony murder charges against Coeytaux for knowingly facilitating what Texas law considers illegal abortions. The complaint cites multiple state law violations, including requirements that abortion drugs be administered only by Texas-licensed physicians, following mandatory informed consent procedures, ultrasound requirements, and administration at licensed facilities. Coeytaux, who lacks Texas medical licensing, allegedly satisfied none of these legal prerequisites.

Testing Blue State Shield Laws

The case represents a strategic test of so-called "abortion shield laws" enacted by blue states like California, New York, and Washington to protect their healthcare providers from legal consequences when treating out-of-state patients seeking reproductive services.

By filing a civil wrongful death action directly in federal court rather than pursuing criminal charges, Rodriguez's legal team has potentially identified a pathway around state-level protections – a move that could provide a new template for anti-abortion litigation in the post-Dobbs landscape.

Rodriguez seeks damages exceeding $75,000, certification of a national class action representing "all current and future fathers of unborn children in the United States," and a permanent federal injunction preventing Coeytaux from mailing abortion medications in violation of state or federal statutes.
