Apple Wages War Against Chinese Tech Giant Over Alleged Apple Watch Secret Theft

The Smoking Gun in Silicon Valley

SAN JOSE, CA - In the cutthroat world of wearable technology, Apple just fired its biggest legal salvo yet against Chinese competition—and the ammunition is explosive. Court documents filed this week in Northern California federal court reveal what Apple claims is a methodical corporate espionage operation, complete with midnight file downloads, encrypted messages in Mandarin, and a former Apple Watch engineer who allegedly sold out his employer's crown jewels.

The target: Dr. Chen Shi, a highly compensated Sensor System Architect who spent five and a half years inside Apple's most sensitive Apple Watch development programs. The prize: trade secrets worth potentially billions, covering everything from unreleased health sensors to internal product roadmaps that could give competitors a massive head start.

But this isn't just another disgruntled employee case. According to Apple's 30-page federal complaint, this was a premeditated heist orchestrated at the highest levels of Guangdong OPPO Mobile Telecommunications Corp. and its U.S. subsidiary InnoPeak Technology—companies that have built their smartwatch business by, in Apple's words, creating products that look "exactly like an Apple Watch."

The Inside Job: How It Allegedly Went Down

The timeline Apple presents reads like a corporate thriller. Starting in April 2025, Dr. Shi was "recruited by the highest levels of the OPPO Defendants' leadership, including the President of its U.S. Research Center and its Vice President of Health," the complaint states. But rather than simply resign and take his expertise elsewhere—which would have been perfectly legal—Shi allegedly embarked on something far more sinister.

According to the complaint, Shi lied to his Apple colleagues about his departure, "falsely claiming that he was returning to China to tend to his elderly parents and had no plans to seek new employment." Meanwhile, he was secretly negotiating with OPPO executives about gathering Apple's most sensitive information.

The smoking gun? A June 4, 2025 message in Mandarin from Shi to Dr. Zijing Zeng, OPPO's Vice President of Health. The translation, according to Apple's filing, is damning:

"I'm planning to start on 6/30. This week I'll inform my team about my resignation. Lately, I've also been reviewing various internal materials and doing a lot of 1:1 meetings in an effort to collect as much information as possible—will share with you all later."

Instead of discouraging this conduct, Dr. Zeng allegedly responded with approval—"alright" and an "OK" emoji.

The Digital Heist: 63 Files in Three Hours

What happened next, according to Apple's forensic analysis, was a sophisticated data exfiltration operation. On June 23, 2025—just three days before his departure—Shi allegedly downloaded 63 files from Apple's secure Box storage system between 9:51 PM and 12:37 AM. The files included:

  • Confidential schematics for temperature sensors and ECG functionality
  • Internal specifications for PPG (photoplethysmography) sensors that measure heart rate and blood oxygen
  • Apple's Silicon Engineering Group documents on proprietary chip technologies
  • Product roadmaps for unreleased Apple Watch features

Shi then allegedly organized these stolen files into a folder labeled "苹果相关" ("Apple Related") and transferred them to a USB drive at 1:09 AM on June 25—one day before his departure.

The Cover-Up Attempt

Perhaps most tellingly, Apple's investigation revealed Shi's consciousness of guilt. On June 16, he searched Google for "how to wipe out macbook." On June 23—the same night he allegedly downloaded the files—he searched "Can somebody see if I've opened a file on a shared drive?"

These searches suggest Shi knew exactly what he was doing and was actively trying to cover his tracks, according to legal experts familiar with trade secret cases.

OPPO's Silicon Valley Shell Game

Apple's complaint also sheds light on what it calls a deliberate shell game by OPPO to obscure its U.S. operations. While InnoPeak Technology appears to be a separate California corporation based in Palo Alto, Apple presents extensive evidence that it's simply OPPO's U.S. research arm operating under a different name.

The evidence includes:

  • OPPO's own website listing "Silicon Valley" as one of its six global research institutes
  • Job postings that refer to InnoPeak as "OPPO US Research Center"
  • A building sign at 2479 East Bayshore Road displaying "OPPO" prominently
  • Employee LinkedIn profiles identifying themselves as working for "OPPO US Research Center"

This corporate structure matters enormously for jurisdiction and enforcement. If Apple can prove OPPO directly operates in California, it strengthens both the court's authority over the Chinese company and Apple's ability to obtain meaningful relief.

The Legal Battlefield

Apple's legal strategy reveals sophisticated thinking about modern trade secret warfare. The complaint brings claims under both the federal Defend Trade Secrets Act (DTSA) and California contract law, seeking:

  1. Immediate injunctive relief to prevent further use or disclosure of Apple's trade secrets
  2. Actual damages from lost profits and competitive advantage
  3. Disgorgement of profits OPPO gained from the alleged theft
  4. Punitive damages for what Apple calls "willful, fraudulent, malicious" conduct
  5. Attorney fees under the DTSA's fee-shifting provision

The DTSA claim is particularly powerful because it allows for federal court seizure orders and provides for double damages in cases of willful misappropriation.

Why This Case Matters Beyond Apple

This lawsuit represents more than just one company's fight against alleged corporate espionage. It's a test case for how U.S. courts will handle increasingly sophisticated trade secret theft by foreign competitors, particularly Chinese companies that have built entire business models around reverse-engineering American innovation.

The wearable technology market is projected to reach $231 billion by 2032, with health monitoring features driving much of that growth. Apple Watch dominates this market, controlling roughly 36% of global smartwatch sales. But Chinese competitors like OPPO, Xiaomi, and others have been rapidly gaining ground with devices that often mirror Apple's design and functionality.

"Trade secret theft by former employees for new employers is always wrong," Apple states in its complaint. "Here, allowing Dr. Shi's and the OPPO Defendants' actions to go unpunished would undermine Apple's commitment to innovation and its substantial investments in pioneering technologies like Apple Watch."

The Broader Implications

For corporate America, this case highlights the vulnerability of trade secrets in an era of global talent mobility. Dr. Shi earned his position through legitimate expertise, but Apple argues he crossed the line from taking general knowledge to stealing specific proprietary information.

For Chinese tech companies operating in the U.S., the case sends a clear message that American courts are prepared to use the full force of federal trade secret law to protect domestic innovation. The DTSA, passed in 2016, was specifically designed to give companies like Apple powerful tools to combat exactly this type of alleged theft.

And for the broader U.S.-China technology competition, cases like this one represent the legal front in what has become an economic cold war over technological supremacy.

What Comes Next

The defendants have not yet responded to Apple's allegations, But Apple's request for emergency injunctive relief means this case could move quickly through the federal court system.

Apple is represented by a powerhouse team from Kirkland & Ellis LLP, including partners Adam Alper, Laura Vartain Horn, and Michael W. De Vries—attorneys who specialize in high-stakes intellectual property warfare for technology companies.

The case has been assigned to the Northern District of California's San Jose division, where federal judges have extensive experience handling complex technology trade secret disputes. Given the strength of Apple's documentary evidence—particularly the alleged Mandarin messages and forensic analysis of file downloads—OPPO and Dr. Shi face an uphill battle.

For Apple, this lawsuit represents more than just seeking monetary damages. It's about sending a message to competitors worldwide: steal our secrets, and we'll use every legal weapon at our disposal to make you pay for it.
