John Bolton Indictment Imminent — Will DOJ Finally Perp-Walk a Washington Insider?

WASHINGTON, DC - In Mid-September, the FBI raided Bolton’s Bethesda, Maryland, home under a court-approved warrant seeking classified national security records.  Bolton’s defense, led by Abbe Lowell, insists he did nothing illegal and that the documents in his possession were from earlier periods in public service — allegedly a common practice among long-time government officials.

Following the raid on Bolton’s home, a Maryland grand jury has been hearing evidence for several weeks, and acting U.S. attorneys reportedly believe they have enough to indict. Meanwhile, DOJ oversight bodies, defense lawyers, and Capitol Hill are watching to see how the DOJ will navigate public optics and political backlash.

Any indictment is likely to include counts under the Espionage Act or unauthorized retention/possession of national defense information, though the exact counts remain under wraps.

The Perp Walk Controversy: Why Comey’s Gentle Treatment Fueled Fury — And What It Means Now

When James Comey was indicted in late September on counts of lying to Congress and obstruction of a congressional proceeding, many in the public and political class reacted angrily —Critics noted that Comey was summoned to court, permitted to walk in voluntarily (through side doors), and did not appear in handcuffs or in visible restraints. There was no public “perp walk”, and no mugshot made available.

Many in conservative and accountability circles viewed that as evidence of a double standard: insiders and powerful former officials get special treatment, while lesser-known defendants routinely face public spectacle.

Perp Walks: The Theater and the Precedent

A “perp walk” — escorting a defendant in handcuffs or restraints before cameras — is controversial. Proponents argue it demonstrates transparency: the public sees that alleged criminals are apprehended lawfully. Critics counter that it undercuts the presumption of innocence, turning criminal procedure into theater.

In Comey’s case, sources allege an FBI agent was suspended for refusing to participate in a planned “showy” perp walk. USA Herald This handling became a lightning rod: critics accused some within the DOJ and FBI of protecting Comey and undermining public confidence in equal application of justice.

The Comey backlash sets a powerful precedent. For Bolton, observers expect DOJ leadership to enforce an equal application of the law when it comes to any potential arrest for Bolton, if indicted, proving that no one is shielded by rank.

Thus, for Bolton, the expectations are clear:

  • Handcuffs, public escort, immediate mugshots
  • Booking, fingerprinting, standard arrest procedure

Criminal Exposure

If indicted, Bolton faces serious exposure under statutes governing national defense information, unauthorized possession or retention, and potential Espionage Act violations. The government’s affidavit suggests the materials removed from his home were far from benign. AP News
