Judge Rules Pedro Hernandez Must Be Re-Tried or Released in 1979 Etan Patz Murder Case

In a new twist in one of America’s most haunting missing child cases, a federal judge has ruled that Pedro Hernandez, who was convicted of abducting and murdering Etan Patz, must be re-tried by June 1, 2026. If there is no trial, he must be released.

 The decision, delivered Friday by U.S. District Judge Colleen McMahon in New York, marks another dramatic turn in what she called “the nearly half-century-long saga of the disappearance and presumptive murder” of the six-year-old boy.

The Etan Patz Disappearance Changed America

Etan Patz disappeared in 1979 while walking to his school bus stop alone in SoHo, Manhattan. This case changed the nation’s awareness of child abductions. Etan’s face became the first to appear on milk cartons, igniting nationwide efforts to track and protect missing children.

At the time of the disappearance, Hernandez was a teenager working at a nearby convenience store. Police questioned him but did not suspect his involvement.

Thirty years later, in 2012, a tip led investigators back to Hernandez after reports surfaced that he had once claimed to have killed a child in New York — though he hadn’t mentioned Etan’s name.

Etan Patz Case: Trials, Appeals, and Controversy

Hernandez’s first trial in 2015 ended in a hung jury. In 2017, after a retrial, he was convicted of kidnapping and murder and sentenced to 25 years to life. However, his conviction relied heavily on confessions — despite a lack of physical evidence.

Hernandez’s defense argued that he suffers from mental illness and a low IQ, which may have caused him to make a false confession. “We have a man sitting in jail now for 13 years that the 2nd Circuit said was innocent,” said defense attorney Harvey Fishbein after the latest hearing.

Earlier this year, a federal appeals court ruled that Hernandez’s conviction was wrongful due to a judicial error during his state trial, ordering either a retrial or release within a reasonable time frame.

NBC New York reports that the ruling effectively forces prosecutors to decide the next step soon.

Prosecutors Weigh Options as Time Runs Out

Assistant District Attorney Matthew Colangelo, representing Manhattan DA Alvin Bragg’s office, said prosecutors might not decide for several months whether to retry Hernandez or appeal to the U.S. Supreme Court.

Colangelo noted that time has made retrial preparations difficult. Many of the 50 witnesses from the 2017 trial have either moved away or cannot be located. “We’ve spoken to about two dozen of them,” Colangelo said, highlighting the challenges facing the prosecution.

Judge McMahon acknowledged the difficulty, saying it was not her role “to read the tea leaves and make predictions.” Still, she ruled that if jury selection does not begin by June 1, 2026, Hernandez must be released.

A Case That Still Haunts SoHo

Nearly 50 years after Etan Patz disappeared, the case continues to shape the nation’s understanding of justice, memory, and loss. 

Whether Hernandez will face a third trial or walk free remains unknown — but Judge McMahon’s deadline ensures that the next chapter in this long-running legal drama must come soon.
