Carl Sagan’s “Extraordinary Claims Require Extraordinary Evidence” Meets the 3I/ATLAS “Don’t Look Up” Moment

The interstellar object 3I/ATLAS, now moving toward its October 29 perihelion, has become the latest flashpoint where science, speculation, and philosophy collide. It’s not just a question of astronomy; it’s a question of belief, evidence, and how we, as humans, decide what to take seriously when the sky sends us something we’ve never seen before.

Carl Sagan’s maxim — “extraordinary claims require extraordinary evidence” — has long been the scientific gold standard for skepticism. It reminds us that remarkable ideas need equally remarkable proof. Yet, in the courtroom of law, the standard of evidence is far lower. Judges and juries often decide life-altering matters on a preponderance of the evidence — that is, something being more likely than not to be true. The difference between the two worlds — science and law — may determine how we respond to the mystery of 3I/ATLAS.

At this moment, the public seems to hold four distinct positions about the object. Some view it as a scientific marvel worthy of study; others see it as an unknown anomaly that defies explanation. A few, like Harvard astrophysicist Avi Loeb, believe there’s a non-zero chance it could be alien technology — possibly even a mothership releasing probes. And many people, perhaps the majority, don’t care at all.

But what if this weren’t a question for astronomers, but a case before a judge? What if the issue wasn’t scientific certainty, but legal plausibility? Could the evidence — or even the absence of it — convince a court that this object might not be natural?

In science, you need extraordinary evidence to elevate an extraordinary claim. But in court, you only need to show that something is more probable than not. If 3I/ATLAS were a defendant in a legal proceeding, the plaintiff’s case might rely on a combination of circumstantial and direct evidence: anomalous trajectories, out-gassing inconsistent with known physics, chemical compounds that appear engineered, or perhaps a sudden deviation during its period of invisibility behind the Sun. Each individual point might not prove the case — but taken together, they could persuade a reasonable judge that something artificial is at play.

Avi Loeb has argued that as the object approaches solar conjunction, it could theoretically perform an Oberth maneuver— using the Sun’s gravity to slingshot itself in a new direction. “If you want to take a vacation, take it before then, because who knows what will happen,” he joked, only half-seriously. He’s estimated a 30–40 percent likelihood that the object isn’t entirely natural — a “black swan” scenario that could, in his words, “masquerade as a comet.”

NASA’s own scientists, including Tom Statler, disagree. “It looks like a comet. It does comet things. It behaves like a comet,” Statler told The Guardian. “The evidence overwhelmingly points to this being a natural body.” That’s the official position — the one rooted in peer-reviewed observation, repeatable data, and conservative judgment.

Still, the Don’t Look Up analogy looms large. In Adam McKay’s film, scientists frantically warn the world of an approaching comet only to be ignored until it’s too late. 3I/ATLAS is not on a collision course with Earth, but it shares something eerie with that fictional story — a sense that humanity may again be watching an event of cosmic significance without fully understanding it. And if it were artificial, we might not even know until after it had already acted.

Right now, 3I/ATLAS is slipping behind the Sun — a period known as solar conjunction. During that window, Earth-based telescopes can’t see it. It will reach perihelion, its closest approach to the Sun, on October 29. That’s when comets tend to release volatile gases and change brightness — and, in Loeb’s more radical hypothesis, when an artificial object could execute a controlled maneuver. When it re-emerges from behind the Sun, scientists will compare its position and speed against predictions. Any unexplained shift would fuel the kind of public frenzy seen only in Hollywood thrillers.

In the law, a judge might say the burden of proof rests not on proving alien origin beyond all doubt, but on whether observable evidence makes that origin more likely than not. If post-conjunction data show non-gravitational acceleration, non-natural composition, or emission of smaller objects, the legal argument for artificiality could suddenly meet that “preponderance” standard.

The hypothetical court’s ruling would be historic: the first judicial acknowledgment that an interstellar object likely originated from intelligent design. The scientific community might still require another decade of verification — but public policy, defense planning, and global consciousness could change overnight.

And that’s the real point of this thought experiment. In law, there’s such a thing as the precautionary principle — the idea that you don’t wait for catastrophe to prove itself before you prepare. If there’s even a small probability of a high-impact event, you act early. That’s what “Don’t Look Up” got right: denial delays consequence, but it doesn’t prevent it.

So maybe the lesson of 3I/ATLAS isn’t whether it’s alien or not. Maybe it’s that our species has two different ways of recognizing truth — one for science and one for survival. Science demands certainty. Law demands reasonableness. But both, in the end, seek the same thing: enough proof to justify belief before it’s too late.

As of this writing, NASA classifies 3I/ATLAS as an interstellar comet, and no evidence of artificial behavior has been detected. Still, as Loeb notes, “The remote possibility of an Oberth maneuver must be considered seriously as a black swan event — because of its huge implications for humanity.”
