At the heart of the case is a troubling allegation: that recruiters, acting on behalf of the company, posted job listings that effectively discouraged qualified American workers from even applying. According to federal findings, some of these postings included citizenship restrictions not permitted under law, signaling preference for foreign visa holders—particularly H-1B workers—while excluding U.S. citizens and lawful permanent residents from consideration.

That kind of practice, federal officials say, isn’t just unethical—it’s illegal.

“It’s illegal to discourage U.S. workers from applying for American jobs,” said Harmeet K. Dhillon, delivering a statement that reads less like routine enforcement and more like a warning shot across the bow of employers nationwide. “Employers cannot exclude U.S. workers from the labor force by discriminating against them based on their citizenship status.”

The settlement reflects both financial accountability and systemic reform. Compunnel has agreed to pay $58,000 in back pay to a U.S. citizen who was denied consideration for a Python Developer position due to his citizenship status. The company will also pay $255,420 in civil penalties to the U.S. Treasury—bringing the total enforcement action to over $313,000.

But the real impact may lie beyond the dollar figure.

Under the agreement, Compunnel must implement corrective measures designed to prevent this type of discrimination from happening again. That includes enhanced compliance systems, mandatory training for recruiters, and active monitoring of hiring practices. In other words, this isn’t just about punishment—it’s about forcing structural change inside corporate hiring pipelines.

This case marks the ninth enforcement action since the federal government re-launched its Protecting U.S. Workers Initiative in 2025, a program aimed squarely at rooting out citizenship-based discrimination in hiring. The initiative operates under the authority of the Immigration and Nationality Act, which prohibits employers from favoring foreign visa holders over equally qualified U.S. workers without lawful justification.

And make no mistake—this initiative is gaining traction.

Federal officials have made it clear that they are not only willing to pursue these cases but intend to seek maximum penalties where violations are found. Each settlement sends a message: recruitment practices that filter out Americans—whether overtly or subtly—are now firmly in the government’s crosshairs.

From a broader perspective, this enforcement trend raises deeper questions about the integrity of the U.S. labor market. In an era where high-skilled jobs—particularly in tech—are increasingly competitive, even minor barriers to entry can have outsized consequences. When job postings are structured in a way that deters U.S. applicants, it doesn’t just impact individual workers—it distorts the market itself.

That’s why this case matters.

It’s not just about one company or one job listing. It’s about a pattern the federal government is now actively dismantling—one where hiring practices quietly tilt the playing field away from American workers.

For workers who believe they’ve been subjected to similar discrimination, the Justice Department is urging action. The Immigrant and Employee Rights Section offers a hotline and resources for both employees and employers seeking guidance on compliance and reporting violations.

As enforcement ramps up, one thing is becoming increasingly clear: the era of unchecked hiring discrimination—particularly when it comes to citizenship status—is facing a reckoning.

And for employers across the country, the message is simple—comply, or pay the price.
