Florida’s Attorney General Just Declared War on OpenAI — And He’s Not Playing Around

In a move that is already sending shockwaves through Silicon Valley, Wall Street, and every school board meeting room in America, Florida has officially launched a formal state investigation into OpenAI and its flagship product, ChatGPT — and the Attorney General is not mincing words about why.

"AI should advance mankind, not destroy it," Uthmeier wrote in a post that has already gone viral, adding that his office is "demanding answers on OpenAI's activities that have hurt kids, endangered Americans, and facilitated the recent FSU mass shooting."

Let that last part sink in for a moment. The Florida State University mass shooting. One of the most devastating and traumatic events to rock the Sunshine State in recent memory. And now Florida's top law enforcement officer is pointing a finger — at least in part — directly at the most powerful and widely used artificial intelligence company on the planet.

This is not a press release. This is not a political stunt buried in legislative committee language that nobody reads. This is a sitting Attorney General, using the full investigative authority of his office, going after OpenAI with the kind of language that signals he believes there is a real case to be made here. And if you know anything about how these state-level investigations tend to unfold, you know that when an AG's office publicly announces it is "demanding answers," documents have already been requested, legal teams are already mobilized, and the target of the investigation already has lawyers working overtime.

The timing of this announcement is significant on multiple levels. OpenAI has been under growing scrutiny from federal lawmakers, foreign governments, academic researchers, and child safety advocates for months — but this marks one of the most aggressive and direct state-level legal actions taken against the company to date. Florida has positioned itself at the tip of the spear, and Uthmeier appears ready and willing to use every tool available to him under state law to compel transparency from an organization that has, by many accounts, operated with an extraordinary degree of opacity for a product used by hundreds of millions of people worldwide.

The mention of children is not accidental. It is deliberate, strategic, and legally loaded. Across the country, parents, educators, therapists, and law enforcement professionals have been raising alarms about the ways in which AI chatbot platforms — including ChatGPT — have been accessed and exploited in ways that endanger minors. From generating harmful content to being used as a tool by bad actors to manipulate vulnerable young people, the intersection of unchecked AI capability and child safety has become one of the defining legal battlegrounds of our time. Florida is now planting its flag squarely in the middle of that battlefield.

And then there is the FSU shooting connection — which is the thread that, once pulled, could unravel an entirely new dimension of the AI accountability conversation in this country. The details of exactly how OpenAI's platform is alleged to have played a role in facilitating that tragedy are still emerging, and this investigation will be the mechanism by which those details either come to light or are buried under layers of corporate legal defense. The American public deserves to know which one it will be.

What Uthmeier is doing here — whether you agree with his politics or not — is asking the question that official Washington has been dancing around for years: at what point does a technology company become legally liable for the real-world harm its product enables? We have had that conversation about social media. We are now, apparently, going to have it about artificial intelligence. And Florida just forced the issue into the open.

The implications of this investigation stretch far beyond Florida's borders. If the AG's office finds actionable wrongdoing, it could set a legal precedent that triggers a cascade of similar investigations in other states. It could force OpenAI into the kind of public reckoning it has thus far managed to avoid.

It could reshape the regulatory landscape for AI in America at a moment when the federal government has struggled to move with anything approaching the speed this technology demands. And it could, potentially, change the way AI companies design, deploy, and monitor their products in ways that actually protect the people using them — especially the youngest and most vulnerable among us.

"Wrongdoers must be held accountable," Uthmeier said. Four words. But in the context of a formal state investigation into the most consequential technology company of the 21st century, those four words carry enormous legal weight — and they should.
