Not a jury. Not a trial judge. Under American extradition law the final word belongs to a serving politician — and the courts are barred from asking most of the questions that matter.

The question sounds procedural and turns out to be constitutional. Andrew and Tristan Tate are in federal custody in Miami. Britain wants them. Somebody will decide whether Britain gets them. Almost everyone assumes that somebody is a judge, and almost everyone is wrong.

Here is the answer, stated first and unpacked afterwards: a federal magistrate judge decides only whether the request is legally sufficient, and the Secretary of State decides whether the men are actually surrendered. The judicial stage is narrow by design. The final stage is political by design. Understanding the difference is the whole of understanding this case.

Stage one: the request

Extradition from the United States begins with a diplomatic request, not a police decision. Britain's Crown Prosecution Service authorised thirty-eight further charges in July, bringing Andrew Tate's total to forty-two counts and Tristan Tate's to seventeen, involving seven alleged victims and conduct alleged between July 2010 and August 2017. Both men deny all of it. That charge sheet becomes a formal request transmitted through the State Department, and Britain has until 16 September to submit the complete package.

Note the sequence, because it is the detail people find hardest to believe: the arrest came first. The brothers were taken into custody by US Marshals on 18 July. The document justifying that custody is due nearly two months later. This is lawful — provisional arrest ahead of a full request is standard practice under most modern treaties — but "lawful" and "comfortable" are different words.

Stage two: the magistrate, and the four questions

The court's role is set out in 18 U.S.C. § 3184, which authorises a magistrate to hear the evidence and, if satisfied, certify the case to the Secretary of State DOJ. What that hearing is not is a trial. There is no jury. There is no verdict. Guilt is not the subject.

The magistrate examines roughly four things. Whether a valid treaty exists — with Britain it plainly does, under the 2003 US–UK treaty. Whether the person before the court is the person sought. Whether dual criminality is satisfied, meaning the alleged conduct would be a crime in both countries at a qualifying threshold Senate hearing record — rape and trafficking offences clear this bar without difficulty. And whether there is probable cause: some competent evidence supporting the charges.

Probable cause is the standard that surprises people. It is not "beyond reasonable doubt." It is not even the civil balance of probabilities. It is a threshold showing, and the accused cannot mount a full defence against it. Contradictory evidence is largely inadmissible; witnesses generally cannot be cross-examined as they would be at trial. The hearing asks whether Britain has enough to try them, not whether Britain is right.

Stage three: the rule that closes most doors

Then comes the doctrine that shapes everything the Tates' lawyers can and cannot say. It is called the rule of non-inquiry, and it holds that American courts do not investigate the fairness of the requesting country's justice system, the motives of its prosecutors, or the treatment awaiting the accused. Those are matters for the executive branch, not the judiciary Cardozo Law Review.

This is why "political prosecution" arguments so rarely succeed in the courtroom. When the brothers' attorney Joe McBride called the case a "stitch up job" and the extradition a "political kidnapping", the striking thing is not that the claim is inflammatory. It is that the forum is structurally deaf to it. A magistrate is not permitted to weigh whether the timing of the charges was tactical, whether Britain moved because the men had become reachable on American soil, or whether the case that collapsed twice in Romania says anything about the strength of the evidence. Those arguments have only one available audience, and that audience is not judicial.

The political offence exception does exist — it bars extradition for genuinely political offences — but the 2003 treaty narrowed it considerably, and it was never intended to cover ordinary criminal allegations regardless of how politically charged their context becomes CRS. Sexual offence charges will not qualify. Extradition between the US and UK is refused only rarely.

Stage four: no appeal, but one back door

If the magistrate certifies the case, there is no conventional right of appeal. The only judicial route left is a petition for a writ of habeas corpus in the district court, which reviews whether the magistrate had jurisdiction, whether the offence falls within the treaty, and whether any evidence supported probable cause State Department FAM. It is a review of legality, not of merits, and it is a narrow gate.

Stage five: the politician

And then the certified case goes to the Secretary of State, who makes the final decision to surrender or not DOJ.

Sit with that. Not a jury of citizens. Not the trial judge. A cabinet officer — a serving member of an administration, holding a political appointment, exercising a discretion that is essentially unreviewable. The Secretary may consider humanitarian factors, treaty relations, diplomatic consequences, and considerations that need never be published. The Secretary may also decline. Nothing in the statute compels surrender.

This is where the case's history stops being background and becomes structure. Whatever one concludes about that episode, the American legal system has now routed the final decision on these men to the precise branch of government where such influence, if it exists, would operate. The courts will handle the parts of the question that cannot accommodate politics, and then hand the part that can to a politician.

What this means for the calendar ahead

A detention hearing is listed for 13 August before Magistrate Judge Lauren Louis, deciding only whether the brothers stay in jail meanwhile. Britain's full request follows by 16 September. An extradition hearing comes after that. A habeas petition is likely if certification issues. And at the end of the chain sits a desk in Washington.

At no point in that sequence does anyone determine whether Andrew or Tristan Tate did what seven complainants say they did. That determination requires a trial, and a trial requires extradition, and extradition requires a political decision. Four years into this, the mechanism that would finally establish the facts is still gated behind a decision that has nothing to do with facts at all.

Anyone waiting for justice here should understand what they are waiting for — and who is holding it.
