Terrell Owens Sued By Nolan Wells’ Friends After ‘Arrest Them’ Post Ignites Defamation Lawsuit

NFL Hall of Famer Terrell Owens is now a defendant in a federal defamation case brought by three young men who say one social-media post helped turn them into targets of an online mob.

Benjamin Warren Hudson Jr., Eli Jax Pitalo and Morgan Seymour filed suit October 5 in the U.S. District Court for the Southern District of Mississippi. Because each is under 21 and therefore treated as a minor under Mississippi law, their fathers are proceeding as next friends.

The federal docket lists the case as Hudson et al. v. Owens, Case No. 1:26-cv-00292-LG-RPM. District Judge Louis Guirola Jr. is assigned to the case, with Magistrate Judge Robert P. Myers.

At the center of the lawsuit is a September 26 post from Owens' X account.

“ARREST THEM IMMEDIATELY!! LIKE YESTERDAY!!” Owens wrote.

The post linked to an Instagram video from the Trent Out Loud Show displaying Hudson, Pitalo and Seymour and advancing claims that there was probable cause to arrest them over Wells’ death and alleged deletion of information from his cellphone. The plaintiffs deny those accusations.

That context matters legally.

Owens did not simply discuss the unresolved death or ask whether investigators had missed something. According to the complaint, his own words explicitly demanded arrests while directing his audience to content accusing identifiable people of crimes.

The plaintiffs therefore argue that the post, image and linked video must be considered together.

Their complaint asserts defamation per se, alleging the publication effectively accused them of murder, evidence tampering and hindering prosecution. A second count alleges false-light invasion of privacy, claiming Owens portrayed them as killers who participated in a cover-up and escaped justice. They seek compensatory and punitive damages and have demanded a jury trial.

Timing may become one of the most important facts in the litigation.

A Jackson County grand jury returned a unanimous no true bill on September 18. According to the grand jury findings cited in the complaint, investigators found “no credible evidence” that people aboard the boats engaged in criminal conduct connected to Wells’ death. District Attorney Angel Myers McIlrath publicly announced the findings September 21. Owens posted five days later.

Wells, 18, disappeared during a July 4 outing involving roughly 30 friends on Horn Island. His body was recovered July 6.

The broader mystery surrounding his death has not disappeared. State and independent autopsies did not conclusively determine his cause of death, although the grand jury found the circumstances consistent with drowning. Wells’ family disputes aspects of the investigation and continues pressing for federal authorities to investigate.

That distinction is crucial. Questions surrounding Wells’ death may remain. But unanswered questions do not automatically supply a factual basis for publicly accusing specific people of crimes.

The plaintiffs say Owens’ enormous reach made the consequences worse. Owens had approximately 1.2 million X followers, and the lawsuit alleges the young men subsequently endured threats, harassment and fear for their safety. Owens had also previously pledged $25,000 toward a reward for information leading to an arrest and conviction related to Wells’ death.

As of the latest reporting reviewed by USA Herald, Owens had not publicly responded to the lawsuit.

What makes this case especially significant is the legal line it may test in the social-media age. A celebrity can express suspicion, criticize an investigation and demand answers. But when a speaker with a massive audience names identifiable individuals and calls for their arrest while distributing accusations of murder or evidence tampering, a court may eventually have to decide whether that crossed from protected commentary into an actionable statement of fact.
