“Based on our direct interactions with and observations of him, he is someone for whom many jurors will want to identify reasonable doubt. It would be difficult to convince a jury that they should convict him-by then a former president well into his eighties-of a serious felony that requires a mental state of willfulness,” Hur added.
He noted instances where Biden’s memory appeared significantly limited, such as his inability to recall when his vice presidency ended or when his son, Beau Biden, passed away.
According to the report, Biden’s memory lapses were evident during interviews with a ghostwriter for a memoir and in private sessions with Hur’s team.
The report noted at least 9 lapses included forgetting key events during his vice presidency and struggling to recall details of important debates, such as the Afghanistan conflict.
The report drew sharp criticism from Biden and his legal team. The President’s attorney’s Bob Bauer and Richard Sauber criticized Hur’s emphasis on Biden’s memory issues. And claimed they were inappropriate and politically motivated.
