“For instance, did those statements appear on defendants’ website, in advertising, or on the cooking spray label?” the judge questioned. “The amended complaint does not answer those questions.”

Explosive Incident and Legal Proceedings

The lawsuit originated from an incident in June 2017 when Ericson, a worker in a food truck, experienced an explosion allegedly caused by a cooking spray manufactured and sold by Full-Fill and Conagra. The spray reportedly began releasing its contents through vents in the can, resulting in a burn injury to Ericson. Despite claims that the can was used in a reasonably foreseeable manner and kept away from heat sources in the truck, the situation escalated into a legal battle.

Conagra Cooking Spray Burn Suit : Judicial Progression

This dismissal comes after Judge Valderrama’s previous rulings in September 2021. During that phase, the judge dismissed negligence, nonspecific defect claims, and unfair and deceptive practices claims under Massachusetts General Law. However, design defect, manufacturing defect, and failure to warn claims were allowed to proceed.
