Erika Kirk Seeks Public Release of Court Exhibits in Charlie Kirk Killing Case

Erika Kirk, the widow of Turning Point USA co-founder Charlie Kirk, has asked a Utah judge to allow exhibits introduced during a preliminary hearing in her husband's killing to be displayed publicly in open court.

She is arguing that greater transparency is needed to combat misinformation and conspiracy theories surrounding the case.

Tyler Robinson Accused of Charlie Kirk Murder

The request was made during the preliminary hearing for Tyler Robinson, who is charged in connection with the fatal shooting of Charlie Kirk at Utah Valley University in September 2025.

Robinson has not entered a plea, and the hearing is intended to determine whether prosecutors have presented enough evidence for the case to proceed to trial.

Judge Tony Graf ultimately denied the request to require all exhibits to be displayed publicly, ruling that the court would continue using a tiered approach when deciding which evidence is shown in the courtroom and which is released to the public.

Erika Kirk Attorneys File Motion Seeking Public Access

According to a motion filed by Erika Kirk's attorneys, members of the Kirk family attended the hearing to observe the proceedings but were unable to view some evidence that had been admitted by the court.

The filing argued that crime victims and their families have the right under Utah law to meaningfully observe court proceedings. Attorney Jeffrey Neiman told the court that preventing the family from viewing certain exhibits diminished that right.

"The Kirk family believes strongly that if the evidence is being admitted in this preliminary hearing, it should be made public for the world to see," Neiman said during the hearing.

The motion also argued that limiting public access to evidence could contribute to speculation about the case.

Judge Cites Need to Protect Both Erika Kirk and the Defendant

Judge Graf acknowledged the family's concerns but said the court also has an obligation to protect the rights of both the victims and the defendant.

In denying the request, Graf said exhibits would continue to be handled individually. Under the court's procedure, some evidence may be admitted for judicial review without being displayed publicly, while other exhibits may be shown to those in the courtroom or released through the court's public video feed.

The judge said the approach is intended to balance transparency with the defendant's right to a fair judicial process.

Court Hears Testimony and Reviews Evidence

The hearing continued with testimony and the presentation of evidence offered by prosecutors.

Despite objections from the defense, Judge Graf allowed portions of a recorded interview and text messages involving Robinson's former roommate, Lance Twiggs, to be introduced after certain material was redacted.

According to prosecutors, Twiggs was interviewed by investigators shortly after Charlie Kirk's death and again several months later. Court testimony indicated Twiggs received immunity from prosecution in exchange for his cooperation with investigators.

Defense attorneys argued against admitting portions of the interview, saying they were concerned jurors could improperly interpret the statements as a confession by Robinson.

Judge Graf ruled that the redacted material could be considered during the preliminary hearing.

DNA Evidence Presented During the Hearing

Throughout the week, prosecutors also introduced surveillance video, forensic evidence and testimony from law enforcement officers and university personnel.

According to court proceedings, prosecutors presented video they allege shows Robinson entering the Utah Valley University campus and later climbing onto a rooftop before the shooting.

Defense attorneys challenged portions of the video evidence, arguing that annotations and highlighted images added by investigators could improperly influence how the evidence is viewed.

Attorneys also disputed issues involving DNA testing and the chain of custody for several pieces of physical evidence, including a rifle recovered in nearby woods, a towel in which it was reportedly wrapped, and a screwdriver recovered from the rooftop area.

Those issues remain part of the evidence Judge Graf will consider in determining whether probable cause exists for the case to move forward.

Balanced Transparency for Erika Kirk and Family and Robinson

Charlie Kirk was fatally shot on Sept. 10, 2025, while speaking at an event at Utah Valley University, according to prosecutors. He was transported to a nearby hospital, where he later died from his injuries.

Prosecutors allege Robinson surrendered to authorities approximately 36 hours after the shooting.

During the preliminary hearing, prosecutors presented evidence they contend connects Robinson to the shooting. Defense attorneys have challenged portions of that evidence and argued that Robinson's constitutional rights must be protected throughout the proceedings.

The preliminary hearing is expected to conclude after Judge Graf determines whether prosecutors have established probable cause for the case to proceed to trial. If probable cause is found, the case will advance to arraignment and subsequent pretrial proceedings before any trial is scheduled.

What Happens Next?

The Erika Kirk motion was rejected by the judge.

At the conclusion of the preliminary hearing, Judge Graf will decide whether sufficient evidence exists under Utah law to bind the case over for trial.

If the judge finds probable cause, Robinson will face formal arraignment, where he will enter a plea if one has not already been entered. The case would then move into the pretrial phase, during which both prosecutors and defense attorneys may file additional motions, exchange evidence, and prepare for trial.

Throughout the proceedings, Robinson is presumed innocent unless proven guilty in court.
