Federal Circuit Judge Pauline Newman, at 98 years old, has become the target of one of the most aggressive and questionable campaigns ever waged against an Article III judge. In a unanimous ruling on Friday, her colleagues once again extended her suspension for another year, citing her refusal to submit to medical testing by their handpicked doctors.

The Judicial Council insists that Judge Newman is guilty of “misconduct” for refusing to cooperate with their demand that she undergo neuropsychological testing by experts they alone select. They rely on the Judicial Conduct and Disability Act, 28 U.S.C. §§ 353–354, and claim that suspension is the only way to enforce their order.
