Federal Court Revives Amazon’s Alexa Lawsuit

The plot thickened in 2018 when RPI, bolstered by CF Dynamic, lobbed an infringement grenade at Amazon. They asserted that the tech behemoth knowingly infringed upon the patent, targeting a spectrum of voice processing gizmos, notably Alexa Voice Service, Amazon Echo, Amazon Fire, and a myriad of Alexa-integrated devices.

In a prior skirmish in April 2020, Amazon’s attempt to quash RPI’s lawsuit was thwarted. Judge Sannes upheld a magistrate judge’s stance, affirming the sanctity of the exclusive licensing pact between Dynamic Advances and CF Dynamic.

However, Amazon, ever tenacious, spotlighted procedural intricacies, arguing that the license hadn’t transitioned properly to CF Dynamic due to Dynamic Advances’ neglect in seeking mandatory consent during its sale to Marathon Patent Group Inc.

In a new twist this year, Amazon asserted that a newly-revealed patent license agreement exposed DBD Credit Funding LLC’s unchecked rights to license the contentious patent since 2017. Judge Sannes, however, offered clarity on Friday, stating that Dynamic Advances could never confer an absolute sublicensing right to DBD Credit.
