A landmark ruling from the Supreme Court of the United States has reignited debate nationwide, as the Justice rejects conversion therapy ban decision threatens to ripple beyond Colorado and into states like Minnesota.

High Court Sides With Counselor in Free Speech Clash

In an 8-1 decision, the court backed a Colorado counselor who argued that restrictions on conversion therapy unlawfully limited her conversations with minor patients. The ruling struck down Colorado’s ban on the practice for minors, framing the issue as one of constitutional speech rather than solely public health.

While the decision does not immediately nullify Minnesota’s law, legal advocates warn it could crack open the door to challenges.

Minnesota’s Protections Now Under Scrutiny

Minnesota lawmakers passed their own prohibition in 2023, making it the 21st state to restrict licensed mental health professionals from engaging in conversion therapy with minors. The law also blocks medical assistance from covering the practice and bans misleading advertising tied to it.

The legislation, approved during a Democratic-Farmer-Labor trifecta, drew bipartisan backing—passing 81-46 in the House and 36-27 in the Senate.

But now, the ground beneath those protections feels less solid.

Advocates Warn of Legal Fallout

Jess Braverman, legal director at Gender Justice, said the ruling creates an opening for legal challenges against Minnesota’s ban on talk-based conversion therapy.

Still, she emphasized that safeguards remain in place. Licensed professionals must continue to follow accepted standards of care, and those harmed by such practices may pursue accountability through malpractice claims.

“There are other mechanisms in place,” Braverman said, pointing to legal avenues that remain available despite the ruling.

Scientific Consensus at Odds With Practice

Conversion therapy—an attempt to alter a person’s sexual orientation or gender identity—has long been discredited by major health authorities. The American Psychological Association states the practice lacks evidence, while a 2022 review by the Minnesota Department of Health linked it to depression and suicide attempts.

Braverman noted that the court’s decision applies narrowly to talk therapy and does not extend to more extreme methods, such as aversion therapy, which remain banned where prohibited.

Lawmakers and Advocates React

The Minnesota Queer Legislators Caucus issued a sharp rebuke, saying the ruling could expose vulnerable youth to harm.

“It is horrifying,” the group said, warning that such practices undermine dignity and authenticity.

Behind the scenes, the caucus is coordinating with the state attorney general and agencies to assess the ruling’s reach and defend existing protections.
