Trump Settles with IRS Over Lawfare and Weaponization Claims

The Trump administration has reached a major legal settlement involving allegations of government Lawfare and weaponization used against him during his last term.

A massive $1.776 billion fund was created to address claims from individuals who believe they were unfairly targeted by federal agencies. The agreement stems from President Donald Trump’s lawsuit against the Internal Revenue Service and the Treasury Department over the leak of his tax returns.

Anti-Weaponization Fund Settles Lawsuit

Acting Attorney General Todd Blanche announced Monday that the settlement resolves Trump’s lawsuit against the federal government while establishing what officials are calling an “Anti-Weaponization Fund.” According to the Justice Department, the fund will create a formal process for people who claim they suffered political targeting or government abuse to seek redress.

The announcement immediately sparked controversy in Washington, with critics questioning both the legality and the scale of the settlement.

Trump Lawsuit Focused on Lawfare Through Tax Return Leak

The lawsuit originated after Trump accused the IRS and Treasury Department of improperly allowing a government contractor to leak his tax records to media outlets in 2020. Trump filed the suit earlier this year in federal court in Miami, initially seeking $10 billion in damages.

The lawsuit also included plaintiffs Donald Trump Jr., Eric Trump, and the The Trump Organization.

According to the Justice Department, the settlement does not include direct monetary payments to Trump or his family. Instead, the administration agreed to establish the new compensation fund while also issuing a formal apology to the plaintiffs.

What Is the “Anti-Weaponization Fund” for Lawfare?

Under the agreement, the Justice Department will create a $1.776 billion fund overseen by a five-member commission appointed by the attorney general. The panel will have authority to review claims, issue formal apologies, and potentially provide financial compensation to individuals deemed victims of government “lawfare” or “weaponization.”

The department stated that claims will be accepted through Dec. 15, 2028. Any remaining funds after that date would return to the federal government.

Blanche defended the arrangement in a public statement.

“The machinery of government should never be weaponized against any American,” Blanche said. “As part of this settlement, we are setting up a lawful process for victims of lawfare and weaponization to be heard and seek redress.”

The Justice Department also confirmed that Trump’s legal team agreed to withdraw separate administrative claims seeking approximately $230 million related to investigations conducted during both Trump’s first administration and the administration of former President Joe Biden.

Democratic Lawmakers Attempt to Intervene

The settlement quickly drew backlash from Democratic lawmakers and government ethics organizations.

According to court filings, 93 Democratic members of Congress attempted to intervene in the case, arguing that the agreement could improperly direct taxpayer money toward Trump allies and supporters.

Critics contend the settlement creates constitutional concerns because Trump is simultaneously serving as president while settling litigation involving executive branch agencies under his authority.

The nonprofit watchdog group Citizens for Responsibility and Ethics in Washington, commonly known as CREW, sharply criticized the settlement.

CREW President Donald K. Sherman called the agreement “the most brazen act of self-dealing in the history of the presidency.”

The organization further argued that the arrangement could potentially violate the Constitution’s Domestic Emoluments Clause.

Judge Raises Constitutional Questions About Lawfare Settlement

Before the settlement was finalized, U.S. District Judge Kathleen M. Williams questioned whether the lawsuit itself presented constitutional complications.

Williams noted that Trump was suing agencies that ultimately fall under presidential authority, raising concerns about whether the legal dispute satisfied Article III requirements for an actual case or controversy.

In an earlier filing, Williams wrote that it was “unclear” whether the parties were sufficiently averse to justify federal court involvement.

Trump’s attorneys later argued that the settlement and dismissal process did not require judicial approval, describing the motion as “self-executing.” That legal position effectively bypassed additional court review.

The Most Significant Settlement of a Lawfare Case

Opponents, however, argue the fund creates a dangerous precedent by allowing a sitting president to shape a taxpayer-funded compensation process connected to his own political grievances.

Legal experts also note that the size of the fund — nearly $1.8 billion — makes it one of the most significant settlements involving claims of political or governmental abuse in modern American history.

The case is expected to remain a flashpoint in the ongoing political and legal battles surrounding Trump’s presidency and the broader debate over executive power, accountability, and the role of federal institutions.
