“No Investigation, No Justification,” Says McConnell

The complaint blasts the insurance giant for allegedly failing to investigate the extent of damages before refusing to honor the full claim. McConnell returned the six-figure check, citing a desire to “ensure that its rights to recover all amounts due” were preserved.

“The policy is a valid and enforceable contract,” the lawsuit declares. “At all times relevant to this dispute, the policy was in full force and effect.”

Despite having months of documentation and what McConnell calls “sworn proof of losses,” the insurance company has yet to fully explain its rationale for the partial payout or the delay in resolving the claim.

The Legal Landscape
