In a legal battle that had the restaurant industry on edge, the Mexican eatery chain Agave & Rye has reached a settlement agreement with a group of bartenders and servers who had accused the establishment of exploiting the tipped wage system, thus failing to pay the appropriate minimum wage. This unexpected twist in the courtroom saga was revealed in a joint notice presented to the U.S. District Court for the Northern District of Ohio.

Chain Agave & Rye Settles Minimum-Wage Suit :  Agave & Rye Strikes a Deal

Agave & Rye LLC, along with the former bartender and plaintiff, Brittney Santos, came forward on Friday with a one-page joint notice, confirming a groundbreaking agreement achieved during a mediation session on October 23. The specifics of this agreement remain a well-guarded secret for now, leaving court observers and legal enthusiasts perplexed. However, it is anticipated that the parties will jointly move to seek court approval for the undisclosed terms on December 7. Santos, the former bartender who initiated the lawsuit against Agave & Rye back in May, asserted that the chain had violated minimum wage regulations. Her argument was centered around the alleged misuse of the tip credit system, which, according to her, rendered them ineligible for the tipped minimum wage rate under the Fair Labor Standards Act.

The Complex Allegations

Santos contended that Agave & Rye failed to pay their employees the rightful minimum wage, exploiting a legal loophole despite the chain's ineligibility for the tipped minimum wage rate. Their ineligibility stemmed from the requirement that servers perform significant amounts of untipped "side work." Furthermore, bartenders were often assigned these non-tipped duties when required to work as servers. Santos had passionately emphasized these concerns in her initial complaint. In a puzzling legal maneuver, Santos had alleged not just one but two wage violations: one under the Fair Labor Standards Act and another under the Ohio Constitution. Her grand ambition was to lead a nationwide class action on behalf of current and former bartenders and servers who had worked at Agave & Rye in the past three years, receiving compensation at the tipped minimum wage rate. Notably, Agave & Rye operates not only in Ohio but also in Kentucky, Indiana, Alabama, and Tennessee. Santos had also sought to establish an Ohio subclass within this overarching class action. The joint notice issued on Friday, however, left a lingering question in the minds of many: will the settlement provide relief to the entire proposed class or exclusively resolve Santos' individual claims?

Agave & Rye's Defensive Stance

Before the unexpected settlement development, Agave & Rye had not filed a motion to dismiss the proposed class action. In their response to the complaint, dated June, the restaurant chain staunchly asserted that there was no factual or legal foundation for the allegations. Among their affirmative defenses, Agave & Rye maintained that they had diligently adhered to legal requirements and regulations, asserting that any claims against them should be subjected to arbitration.
