In a decisive move on Monday, the U.S. Supreme Court refused to entertain an appeal in a case involving alleged defects in Honda airbags, delivering a substantial setback to the plaintiff, Christy Williams. Williams had filed a lawsuit against American Honda Motor Co. Inc., claiming that defective airbags caused her eye injury after a car crash.

High Court Turns Down Honda Airbag Injury Case : Discovery Sanction Derails Lawsuit

The high court's decision stems from a prior dismissal of Williams' suit by a Texas federal judge. The judge had imposed a "litigation ending" discovery sanction, cutting Williams' expert witnesses from the case. This action followed Williams' alleged refusal to provide experts for depositions, causing significant delays in the proceedings. The Fifth Circuit later upheld the judge's rulings.

Constitutional Challenge Ignites Legal Battle

In her October 25 petition to the Supreme Court, Williams contended that the district court's sanctions order denied her constitutional right to a jury trial. Under Texas law, product liability plaintiffs must present liability experts at trial to support their claims.

U.S. District Judge J. Campbell Barker, in April 2022, granted Honda's motion to strike Williams' expert witnesses, citing repeated delays and cancellations of scheduled depositions. Concurrently, the judge awarded summary judgment in favor of Honda, emphasizing Williams' conduct's prejudicial impact on the case.

Williams Argues Unprecedented Sanctions Motion

Williams asserted in her petition that the sanctions motion was the first Honda had ever filed in the lawsuit, initiated after a 2017 crash that left her left eye permanently injured. The case, initially filed in 2020, was scheduled for trial in July 2021.

In a twist of events, Williams highlighted a discovery issue in August 2021 when Honda's counsel insisted on a face-to-face deposition despite Williams's expert, William Bradley, recovering from COVID-19. Williams claimed Honda had conducted crash testing a month before Bradley's deposition, a detail overlooked by both the district court and the Fifth Circuit.

The depositions of Bradley and another expert, Dr. Chandra Thorbole, were scheduled for November. However, a day before Bradley's deposition, Williams' counsel learned of Honda's recent crash testing. Subsequently, Williams informed Honda that the deposition would not proceed as planned.

Honda swiftly moved to strike Bradley and Thorbole as expert witnesses, citing Williams' handling of the case as sanctionable misconduct. Judge Barker granted summary judgment in Honda's favor in April 2022, a decision later affirmed by the Fifth Circuit.
