NLRB Urges 7th Circuit To Toss Unions Sanctions Bid

The National Labor Relations Board (NLRB) has vehemently opposed the International Union of Operating Engineers (IUOE) Local 150's attempt to impose sanctions against the agency. This clash has reached a crescendo at the Seventh Circuit, where the NLRB argued against the union's bid, labeling it "wholly inappropriate."

Legal Standoff Unfolds

In a recent opposition brief, the NLRB challenged IUOE Local 150's call for sanctions, asserting that the union cannot introduce arguments pertaining to the lawfulness of a punch-in policy for strike replacement workers. According to the NLRB, under Section 10(e) of the National Labor Relations Act, the union's arguments regarding the legality of punch-in policy changes must have been presented before the NLRB.

"The board's jurisdictional-bar argument was not made in bad faith and, in fact, is correct," stated the NLRB. The agency further emphasized that even if the court were to reject its argument, the union had failed to demonstrate conduct warranting sanctions.

Roots of the Dispute

The dispute traces back to a September 2022 decision by the NLRB, where it concluded that Illinois quarries, part of RiverStone Group Inc., had not violated the NLRA by implementing changes to the punch-in policy for strike replacements. The board found that the company had unlawfully imposed changes without bargaining with Local 150.

IUOE Local 150 demanded sanctions against the NLRB, citing the burden of additional time and resources caused by the board's assertions. However, the NLRB contended that the union had failed to challenge the company's position effectively during administrative proceedings.

Escalation of Tensions

The NLRB accused the union of resorting to intimidation tactics, characterizing the sanctions motion as a desperate attempt to influence the agency's stance. Refusing to yield to what it deemed improper pressure, the NLRB emphasized the importance of a fully informed review by the court.

The Verdict Awaits

Meanwhile, the D.C. Circuit has denied Local 150's motion to transfer another appellate case related to a June NLRB decision, adding another layer of complexity to the legal saga.
