Protecting the 1st Amendment: Rebekah Massie in Surprise, Arizona

An Arizona judge has dismissed all criminal charges against Rebekah Massie, a resident of Surprise, Arizona, who was arrested following a public comment at a city council meeting.

Massie was detained and charged with trespassing and criticizing a public official. Her action of questioning a city attorney’s pay raise allegedly violated a council policy.

The judge ruled that the charges were "objectively outrageous," effectively ending the criminal case against Massie.

Charges Thrown Out

Justice of the Peace Gerald Williams made it clear that the charges filed against Massie in August were unconstitutional, asserting that the city government had crossed the line by trying to control Massie's political speech.

Williams dismissed the charges “with prejudice,” which prevents the case from being refiled against her in the future.

According to Williams, the city’s attempt to regulate not only speech but the content of political speech was a violation of Massie's First Amendment rights.

"No branch of any federal, state, or local government in this country should ever attempt to control the content of political speech. In this case, the government did so in a manner that was objectively outrageous," Williams stated in his ruling.

"The Defendant should not have faced criminal prosecution once for expressing her political views. The Court agrees that she should never face criminal prosecution, for expressing her political views on that date at that time, again.”

Rebekah Massie Speaks Out

Following the dismissal of her case, Massie released a statement expressing her relief and reaffirming her stance on free speech.

“For more than two months I’ve been living with the threat of punishment and jail time — being taken away from my kids, even — for doing nothing more than criticizing the government,” Massie said.

“Free speech still matters in America, and I can’t tell you what a relief it is to have people on my side standing up for our rights with me.”

Incident at City Council Meeting

The incident leading to Massie’s arrest occurred on August 20 during a city council meeting in Surprise, Arizona.

Massie, who had her 10-year-old daughter with her, raised concerns about a public employee’s job performance and questioned whether that employee merited a pay increase.

Surprise Mayor Skip Hall interrupted Massie, stating that the council prohibits citizens from making “charges or complaints” about public officials or employees during public comment sessions.

When Massie challenged the constitutionality of this policy, the mayor ordered her removal, which led to her arrest and the trespass charge.

Judge’s Critique of Council Policy

Judge Williams’ ruling highlighted several constitutional concerns with the city council’s policy.

He described the policy as problematic, particularly due to its restriction on political speech content, which he argued infringed upon Massie’s First Amendment rights. He underscored the importance of protecting free speech, especially when it involves criticism of government employees and officials.

Massie's defense attorney, Bret Royle, also praised the ruling.

“Rebekah should never have been detained, let alone criminally charged, for speaking her mind,” Royle stated.

“That’s the kind of thing that happens in tyrannical countries but should never happen here. No American should face jail time for exercising their freedom of speech, and we’re relieved the court agreed.”

Federal Lawsuit Against the City

While Massie’s criminal case has concluded, her legal battle is far from over. Following her arrest and subsequent release, the city council repealed the rule in question in a unanimous vote on September 17, 2024.

Massie filed a federal lawsuit seeking damages, alleging that her constitutional rights were violated by the city, the mayor, and the arresting officer.

Conor Fitzpatrick, an attorney with the Foundation for Individual Rights and Expression (FIRE), represents Massie in the lawsuit.

Fitzpatrick criticized the city’s actions and warned other governments against similar behavior.

“The fight goes on in Rebekah’s lawsuit against the City of Surprise, Mayor Hall, and Officer Schernicoff,” Fitzpatrick said.

“We want to make it crystal clear to governments across the United States that brazenly censoring people and betraying the First Amendment comes with a cost.”

Free Speech 

Massie’s case has drawn widespread attention and has been seen as a significant stand for First Amendment rights.

Her experience has spotlighted the legal limits of government control over public speech and the risks of punishing individuals for criticizing public officials.

As her civil suit moves forward, the outcome may set a precedent for other cases involving free speech and government restrictions.

Massie’s case reinforces the principle that American citizens have the right to voice their opinions on government actions and policies without fear of legal consequences.
