Presidential Power and UFO Disclosure: What Congress Must Demand Answers To Next?

America ı By Samuel Lopez

Three Legal Questions That Shape This Debate:

  • Presidential Prerogative or National Security Risk? The power of a U.S. president to declassify UFO information and the legal framework behind it.
  • The NDA Paradox: How nondisclosure agreements silence insiders like Lou Elizondo and complicate government transparency.
  • Will Congress Push for Accountability? AARO’s upcoming testimony and the legal challenges to uncovering hidden truths.

By Samuel A. Lopez - USA Herald

[USA HERALD] - The prospect of unlocking classified UFO or UAP (Unidentified Anomalous Phenomena) secrets has fascinated Americans for decades. With President-elect Trump preparing to take office, the question looms: does the president have the legal authority to disclose the truth about UFOs? The short answer? Yes — but it’s complicated.

As the Pentagon's All-Domain Anomaly Resolution Office (AARO) prepares to testify to Congress today, it’s clear that public interest in UFO transparency has never been higher. Yet, the web of secrecy surrounding UAP programs—bolstered by nondisclosure agreements (NDAs) and national security statutes—continues to frustrate citizens, lawmakers, and journalists alike.

Presidential Power to Declassify UFO Secrets

Under the U.S. Constitution, the president holds ultimate declassification authority. This power is rooted in Article II, Section 2, which grants the president control over national security and classified intelligence. Executive Order 13526, signed in 2009, provides a legal framework for managing classified information and specifies that the president can declassify materials at will.

However, disclosing information on UFOs or UAPs isn’t as straightforward as a signature on a document. Presidents must weigh national security risks, such as revealing advanced military technologies or jeopardizing international relations, against the public’s right to know.

The Role of Congress and AARO

Today, AARO Director Jon T. Kosloski will testify before the Senate Armed Services Committee. His testimony follows a wave of UFO hearings that, frankly, have left much to be desired.

Unfortunately, today’s UFO hearings feel more like polite theater than a rigorous investigation. Whistleblowers, including former AARO head Lou Elizondo, have testified about shadowy government programs allegedly reverse-engineering alien craft. Yet, Elizondo’s reliance on NDAs to avoid spilling the juiciest secrets leaves the public skeptical.

NDAs and the Secrecy Dilemma

Elizondo and others like him argue that NDAs are the linchpins preventing them from disclosing groundbreaking evidence of extraterrestrial life. NDAs are legally binding agreements designed to protect sensitive information, but they also raise questions about their misuse.

While NDAs serve legitimate purposes—like safeguarding national security—they can be weaponized to stifle transparency. If Congress doesn’t challenge these legal barriers, whistleblowers will remain silenced, and the public will stay in the dark.

Are We Being Sold “Wolf Tickets”?

The term “wolf tickets,” slang for selling false promises, aptly describes the narratives being pushed by some self-proclaimed UFO experts. Elizondo, for instance, has mastered the art of building anticipation while delivering little substance. He claims the government knows we are not alone, yet his inability—or unwillingness—to back up his claims with concrete evidence is troubling.

This cycle of secrecy and speculation only fuels public frustration. High-resolution photos, alleged crash retrieval programs, and exotic materials are tantalizing rumors, but they remain unverified. Meanwhile, citizen UFO witnesses and independent researchers often produce clearer and more compelling evidence than government-sanctioned programs like AARO or their grainy leaked videos like the Tic-Tac UFO encounter.

What’s Next? Holding AARO and Congress Accountable

Kosloski’s testimony today offers Congress a crucial opportunity to demand transparency. Lawmakers must ask the hard questions:

  • What specific evidence does AARO possess regarding UAPs?
  • What evidence do we have on the existence of extraterrestrial, or extradimensional beings.
  • Are NDAs being abused to suppress critical information?
  • How can Congress ensure proper oversight of secretive extraterrestrial, or extradimensional activity and UAP programs?

Final Thoughts

As a journalist and legal analyst, I’m committed to reporting facts, not fiction. The UFO debate is no longer a fringe topic; it’s a serious issue with profound implications for science, defense, and public trust in government. Whether through executive action or congressional oversight, it’s time for the U.S. government to come clean.
