A Georgia voting rights nonprofit stands accused of retaliating against a worker who dared to speak out about sexual harassment within its ranks, igniting a legal battle over workplace ethics and retaliation. Erin Ferguson, a former operations director at the New Georgia Project, claims he was abruptly terminated after assisting employees in reporting harassment allegations against the organization’s executives.

Ferguson filed his explosive complaint Monday in Georgia federal court, alleging the New Georgia Project fired him under false pretenses. The move, he asserts, came mere days after he participated in an investigation into sexual misconduct. The accused executives, meanwhile, remain employed.

A Nonprofit in Turmoil

Founded by political figure Stacey Abrams, the New Georgia Project has long been celebrated for its mission to empower underrepresented voters, including Black, Latino, LGBTQ, and young communities. But behind the curtain of its activism, Ferguson alleges, lies a troubling culture of retaliation and reputational sabotage.

Ferguson, who joined the nonprofit in February 2022, rose through its ranks, eventually overseeing operations, technology, and special projects. Yet his career came to a screeching halt in January 2024, following his role in assisting employees who alleged harassment by senior leaders.

In one instance, Ferguson directed a harassed employee to contact the human resources and legal departments. Days later, he reported another harassment case involving a top executive. Instead of praise for his integrity, Ferguson alleges, he was labeled "the problem" and dismissed under dubious claims of dishonesty and payment process violations.

Fallout and Repercussions

The consequences of Ferguson’s termination have been dire. According to the complaint, the fallout has left him unemployed, financially devastated, and grappling with emotional and reputational harm. His HIV-positive status has only compounded the challenges, as the loss of employment benefits forced him to shoulder steep medical costs out of pocket.

The allegations extend beyond retaliation. Ferguson accuses the organization of defamation, claiming executives spread rumors that he had stolen from the nonprofit, tarnishing his standing in the nonprofit sector and making future employment prospects nearly impossible.

Seeking Justice

Ferguson’s lawsuit demands justice and accountability. He accuses the New Georgia Project of retaliation, sex discrimination under Title VII, and defamation. His legal team seeks damages that include nearly $387,000 in back pay, $101,000 in front pay, punitive damages, and legal fees.

Amanda Farahany of Barrett & Farahany represents Ferguson, while counsel for the New Georgia Project remains undisclosed.

The nonprofit and its representatives have yet to publicly address the lawsuit, leaving many awaiting clarity in a case that underscores the precarious balance between whistleblowing and workplace retaliation.

A Message for Change?

The allegations have thrust the New Georgia Project, and its leadership, into the spotlight, raising questions about accountability in organizations dedicated to justice and equality. For now, the case unfolds in court, where Ferguson seeks vindication for what he describes as an act of retaliation for simply doing the right thing.
