DOJ Prosecutor Quits, Cries Foul After Being Asked to Scrutinize Biden Climate Spending

In a move that has sent ripples through the Department of Justice and ignited a firestorm of political debate, a seasoned DOJ prosecutor, Denise Cheung, tendered her resignation Tuesday, claiming she was pressured to launch a preliminary inquiry into the Biden administration's climate spending. But is this a case of a principled stand against political overreach, or a calculated act of defiance bordering on obstruction?

The Tipping Point: 

  • The Request: The prosecutor was asked to conduct a routine preliminary review to determine if a more formal investigation would be warranted.
  • The Refusal: Viewing the request as "premature," the prosecutor declined the assignment, and quit.
  • The Revelation: The prosecutor then allegedly leaked her resignation letter to the media, raising questions about potential breaches of confidentiality.

Drawing parallels to the infamous case of former FBI Director James Comey, who famously announced his agency's decision not to recommend charges against Hillary Clinton, Cheung's actions raise serious questions about the role of personal bias in the pursuit of justice.

The Resignation: A Matter of Principle or a Political Statement?

According to sources familiar with the matter, Cheung's superior asked her to conduct a preliminary review to determine whether a grand jury investigation would be warranted. However, Cheung, in her resignation letter “leaked” through published media sources, claims that her superiors had asked her to direct a preliminary investigation into an Environmental Protection Agency funding decision during the Biden administration and according to Cheung, she claims she was asked to use DOJ’s powers to freeze that funding.

But here's where the story takes a sharp turn. Instead of fulfilling the assignment – a routine legal task well within her job description – Cheung allegedly used this opportunity to alert a potential target of a potential internal DOJ investigation against them.

Critics argue, that this is akin to a DEA agent tipping off a drug cartel about an impending investigation. Such actions are not only a breach of trust but potentially a grave violation of ethical responsibilities.

Imagine a scenario where a lawyer, after seven years as a D.A. prosecutor, takes a lucrative job in private practice. Her new client is under investigation by her former office, and she decides to use her inside knowledge to help him. The parallel is undeniable. Cheung's alleged disclosure of internal DOJ information constitutes a serious misstep, revealing a troubling bias.

The Chain of Command: Following the Orders

The directive, according to reports, originated from Emil Bove, the department's acting deputy attorney general, to Ed Martin, whom President Donald Trump has nominated to be the permanent DC US Attorney. Cheung, a long-time DOJ employee, was allegedly tasked with initiating a preliminary review – which she terms an "investigation" – into an Environmental Protection Agency funding decision during the Biden administration. The goal, allegedly, was to freeze that funding, if fraud was discovered.

Cheung claims, that she was asked to review documentation supplied by the Office of the Deputy Attorney General to open a criminal investigation into whether a contract had been unlawfully awarded by an executive agency before the change in Administration and to issue grand jury subpoenas pursuant to this investigation," Cheung wrote in her resignation letter to Martin.

Cheung further noted that she and other experienced white-collar prosecutors questioned whether the DOJ had met its threshold for a grand jury investigation. While Bove's office insisted that it had, citing a Project Veritas video, Cheung and others purportedly believed the evidence was insufficient.

The Threshold of Proof: A Matter of Opinion?

Cheung's stance reveals a potential conflict of interest when it comes to anything related to Biden. It's not her job, as a subordinate, to unilaterally determine whether the DOJ has met the threshold for a grand jury investigation, before her inquiry has even begun. If she possessed such authority, she would be the superior, not the recipient of assignments.

The "threshold" she speaks of isn't a rigid, unyielding standard. Her refusal to even consider the matter is, in itself, quite telling.

To understand the gravity of the situation, it's crucial to understand the general criteria for initiating a grand jury investigation:

  • Probable Cause: This is the cornerstone. A prosecutor must present enough evidence to convince the grand jury that a crime likely occurred and that the person being investigated likely committed it.
  • Complexity of the Case: Grand juries are often employed in complex cases, such as white-collar crime, organized crime, public corruption, and cases where witnesses are afraid to testify.
  • Investigative Needs: A grand jury's power to subpoena witnesses and documents is invaluable when an investigation stalls.
  • Prosecutorial Discretion: The decision to present a case to a grand jury ultimately rests with the office of the prosecutor.

Reportedly, after her initial pushback, the Justice Department wanted to freeze assets in a bank related to the Biden-era EPA funding. This further underscores the seriousness of the inquiry and the potential ramifications of Cheung's alleged actions.

In my view, Cheung's leaked revelations about internal DOJ discussions are a grave concern, which could represent a breach of confidentiality or potentially violate rules of professional responsibility, potentially impacting her future ability to practice law.

This case is a stark reminder of the delicate balance between personal convictions and professional obligations within the justice system. Was Denise Cheung a whistleblower exposing political pressure, or a rogue prosecutor obstructing legitimate inquiry? The answer, it seems, depends on who you ask.
