Los Angeles, CA – In a blistering blow to the coffee giant, a Los Angeles state court jury has ordered Starbucks to shell out $50 million to a delivery driver whose life was forever altered by a scalding spill at a drive-through window.

The verdict, delivered on Friday, March 14, 2025, marks one of the largest payouts in a burn injury case against the coffee giant and underscores the ongoing debate over beverage safety in the fast-food sector.

The jury's decision came after careful deliberation, with nine out of twelve jurors agreeing on the substantial damages award. This amount falls squarely between the $75 million to $125 million sought by Garcia's legal team and the $7.5 million to $10 million proposed by Starbucks' defense.

The events leading to this monumental verdict unfolded on February 8, 2020, when Garcia, while picking up an order at a Starbucks drive-through, received a cup caddy containing hot beverages. Mere moments after the handoff – approximately 1.4 seconds, according to Garcia's attorney Nick Rowley – one of the cups toppled over, spilling scalding hot water intended for tea onto Garcia.

Surveillance footage of the incident, which was presented to the jury, revealed a critical lapse in safety protocols. The cup that spilled was not properly secured, unlike two identical cups placed beside it. This seemingly minor oversight resulted in life-altering consequences for Garcia.

The trial unfolded in two phases, with the jury first determining liability before addressing damages. In a unanimous decision, the court found Starbucks 100% liable for the incident. Furthermore, in an 11-1 ruling, jurors concluded that Garcia bore zero negligence in the matter.

This verdict sends a clear message about corporate responsibility and the duty of care owed to customers. It echoes similar cases in recent years, such as the lawsuit filed by Muriel Evans in Los Angeles, which highlighted a pattern of customers being burned by near-boiling coffee served with faulty lids.

Garcia's legal team argued passionately about the profound impact this incident has had on their client's life. "Injury and damage to every facet of his life," was how Garcia's suffering was characterized during closing arguments. The permanent nature of Garcia's injuries played a significant role in the jury's decision to award such a substantial sum.

However, Starbucks' defense, led by Stephen Pelletier of Price Pelletier LLP, contended that not all of Garcia's ongoing health issues could be directly attributed to the spill. They pointed to Garcia's pre-existing childhood-onset diabetes as a source of many of his difficulties.

Reports indicate that Starbucks receives approximately 80 complaints monthly related to lids popping off, leading to spill hazards and burns. Despite these recurring issues, critics argue that the company has been slow to implement meaningful changes to prevent such incidents.

The temperature at which coffee is served has long been a point of contention. While Starbucks recommends serving coffee at 150-170 degrees Fahrenheit, some lawsuits allege that beverages have been served at temperatures as high as 190 degrees – dangerously close to boiling. At 140 degrees, water can cause third-degree burns in just seconds, highlighting the potential dangers of serving beverages at such high temperatures.

This verdict could set a significant precedent for similar cases across the country. It follows a trend of successful lawsuits against coffee chains for burn injuries, including a $100,000 verdict in favor of a Florida woman who was also burned by Starbucks coffee.

The substantial damages awarded in this case may prompt Starbucks and other fast-food chains to reassess their safety protocols, particularly regarding beverage temperature and lid design. It also serves as a wake-up call for the industry to prioritize customer safety over operational efficiency or cost-cutting measures.

As of the verdict's announcement, Starbucks has not issued an official statement regarding the outcome of the case or any planned appeals. However, the company faces mounting pressure to address these recurring safety issues comprehensively.

Legal experts suggest that this verdict could lead to a series of internal changes at Starbucks, potentially including:

  1. Revising beverage temperature guidelines
  2. Implementing more rigorous quality control for cup lids
  3. Enhancing staff training on safe beverage handling
  4. Investing in research and development for safer packaging solutions

The $50 million verdict against Starbucks serves as a stark reminder of the real-world consequences when corporate practices prioritize efficiency over safety. It underscores the power of the civil justice system to hold even the largest corporations accountable for negligence.
