Harvard Coachs Bias Suit

A former Harvard University women’s ice hockey coach has scored an early legal victory in her fight against the Ivy League institution, as a federal magistrate judge recommended rejecting Harvard’s bid to dismiss her gender bias and retaliation lawsuit.

Kathleen Stone, who led Harvard’s women’s hockey team for nearly two decades, claims she was systematically underpaid, held to unfair standards, and ultimately forced into retirement after raising concerns about gender discrimination. U.S. Magistrate Judge Jennifer C. Boal ruled Wednesday that Stone’s claims were timely filed, paving the way for her case to proceed.

Allegations of Pay Disparity and Retaliation

Harvard had argued that Stone’s claims of retaliation before March 2023 were time-barred and that many of her pay discrimination allegations were too old to be considered. But Judge Boal rejected that argument, saying Stone alleged “a series of discriminatory acts emanating from the same discriminatory animus,” making them part of a continuing pattern rather than isolated incidents.

Stone’s lawsuit paints a troubling picture of gender bias in Harvard’s athletic department. According to her complaint, the university admitted it would never achieve pay equity for female coaches, failed to defend her against hazing allegations, and placed her on a performance improvement plan without offering meaningful support—actions she says were designed to push her out.

Federal Equal Pay Act and Massachusetts Equal Pay Act Claims Move Forward

Harvard also sought to dismiss Stone’s claims under both the federal and state Equal Pay Acts. However, Judge Boal ruled that the Massachusetts Equal Pay Act’s three-year statute of limitations applied and that Stone sufficiently alleged Harvard had willfully violated federal pay equity laws, which extend the filing deadline from two to three years.

Citing the Lilly Ledbetter Fair Pay Act, which recognizes that each discriminatory paycheck resets the statute of limitations, Judge Boal noted that Stone’s federal pay bias claims—dating back to 2017—could proceed. However, she clarified that Stone’s Massachusetts pay equity claim could only cover alleged violations from July 2021 onward.

A Battle Over Harvard’s Handling of Misconduct Allegations

Stone’s legal battle is also fueled by the way Harvard responded to misconduct allegations against her. In early 2023, media reports surfaced accusing her of fostering a toxic team environment. She contends that the allegations stemmed from a disgruntled former player and that Harvard initially assured her that her legacy would outshine the controversy.

However, rather than allowing Stone to publicly defend herself, Harvard launched an outside investigation—something she claims male coaches had routinely been shielded from. She alleges she was forced into retirement in June 2023, only for the university to later release findings concluding that the women’s hockey program had not engaged in hazing.

Key Testimony: Athletic Director’s Damning Admission

Harvard further argued that Stone’s complaints about pay disparities, made in 2017 and 2018, were too far removed from her departure to establish a retaliation claim. However, Judge Boal pointed to a crucial moment in January 2023, when Stone told Harvard’s athletic director that she would have been treated better if she were a man. The director allegedly responded, “This wouldn’t be happening to a men’s coach.”

Harvard attempted to downplay the remark, suggesting it referred to media coverage rather than the university’s own treatment of Stone. But Judge Boal ruled that such factual disputes are inappropriate for dismissal at this stage.

Legal Teams and Next Steps

With the magistrate judge recommending that the lawsuit proceed, the case now heads to a federal district judge for final determination.

Stone’s attorney, Regina Federico, welcomed the ruling, saying she was pleased the lawsuit is moving forward. Harvard, meanwhile, declined to comment.

With high-profile allegations of systemic gender bias and retaliation now heading toward further litigation, Harvard may soon find itself on thin ice.
