Judge Subramanian Admonishes Mark Geragos In Court for Race-Baiting Comments In Diddy Trial – Referral to State Bar Investigation ‘Well Within Court’s Purview’

NEW YORK (USA Herald) — In a tense and explosive courtroom exchange that could carry serious professional consequences, U.S. District Judge Arun Subramanian delivered a scathing reprimand to celebrity attorney Mark Geragos during a robing room session in Sean “Diddy” Combs’ high-profile sex trafficking and racketeering trial. The rebuke centered around Geragos’ inflammatory podcast remarks referring to the prosecution team as a “six-pack of white women.”

Geragos is not officially part of the defense team and has not filed a notice of appearance in the case, yet he has been seen consulting closely with the defense and attending jury selection. He also admitted to speaking “with great frequency” to Combs. His daughter, Teny Geragos, is an attorney of record for Combs.

“Outrageous” and “Unfitting”: Judge Rebukes Geragos

In response to prosecutors’ concerns about Geragos’ public commentary, Judge Subramanian held a robing room conference and addressed the matter head-on.

“I think referring to the prosecution in this case as a six-pack of white women is outrageous,” Subramanian said. “That's not something anyone should say as an officer of the court and a member of the bar.”

When pressed further, Geragos responded with a justification that only heightened tensions: “I think when you’ve got a Black man who’s being prosecuted and the client feels like he’s being targeted, it’s an observation.”

The judge repeated his point, saying: “I think this is ridiculous. I think referring to the prosecution in this case as a six-pack of white women is outrageous.”

When it seemed that Geragos was about to criticize prosecutors over the issue of pretrial publicity, the judge cut him off, saying: “Let's just have some real talk.”

Subramanian then asked Geragos if he knew that was not something that anyone should say “as an officer of the court and a member of the bar.”

Despite the severity of the reprimand, Geragos remained defiant, but Judge Subramanian made it clear that Geragos would be under the microscope going forward, suggesting that he may be listening in on Geragos’ podcast.

“You have one more listener for your podcast,” the judge said visibly displeased.

“As long as you subscribe [to the podcast], I’m all for it,” he told the judge.

A Pattern of Provocation and Outdated Legal Strategist

Geragos’ controversial conduct is not limited to the courtroom. Through his podcast, “2 Angry Men,” co-hosted with TMZ founder Harvey Levin, Geragos has repeatedly criticized prosecutors and questioned the motivations behind the charges.

But what legal observers find increasingly troubling isn’t just the rhetoric—it’s the legal strategy behind it. “Geragos is operating like it’s 1996,” said a veteran defense lawyer. “In his day, winning cases relied heavily on showmanship, personality, and manipulating public perception. But the legal landscape has evolved, and those old-school tactics don’t hold up in today’s courts.”

Others in the legal community have labeled Geragos’ tactics as “old-head lawyering”—a throwback to an era when high-profile trials were often won in the court of public opinion. “He hasn’t advanced in his thinking,” one ethics analyst noted. “His strategies are deeply flawed because they’re based on an outdated mentality that no longer works.”

Mounting Pressure for a State Bar Probe

Legal experts are now calling on the State Bar to investigate whether Geragos has committed professional misconduct by:

  • Implying he is part of the defense without appearing on record;
  • Making racially charged comments that risk prejudicing a jury;
  • Using public platforms to interfere with the administration of justice;
  • Rule 8.4(d) – Misconduct: Prohibits conduct that is prejudicial to the administration of justice;
  • Rule 8.4 (a)(3)Prohibits engaging in conduct involving dishonesty, fraud, deceit, or reckless or intentional misrepresentation. Geragos’ public characterization of prosecutors and implication of racial bias without evidence, particularly in an active federal case, may qualify under this rule;
  • Rule 3.6 – Trial Publicity: Attorneys shall not make extrajudicial statements that they know—or reasonably should know—will be disseminated by means of public communication and will have a substantial likelihood of materially prejudicing an adjudicative proceeding. Geragos’ podcast statements likely fall under this.

Meanwhile, Mark’s daughter, Teny Geragos, is officially listed on Combs' legal team but has largely stayed behind the scenes. Observers speculate that Geragos may be asserting his influence behind the scenes under the guise of mentorship/consultant.

Combs faces deeply serious federal charges, including operating a criminal enterprise, engaging in sex trafficking, and orchestrating drug-laced sex parties—referred to in court documents as “Freak Offs.”

He has pleaded not guilty and remains in federal custody without bail. His attorneys argue the charges are inflated and driven by his celebrity status, alleging that consensual sexual conduct is being recharacterized as criminal behavior.

Jury Selection Nearing Conclusion

Judge Subramanian is expected to conclude voir dire by Friday, with opening statements scheduled for Monday. The courtroom remains tightly controlled as prospective jurors are questioned individually to ensure impartiality.

Both the prosecution and defense will have the opportunity to use peremptory challenges to finalize the 12-member jury and 6 alternates.
