Abrego Garcia Returns to U.S. With New Federal Charges

Kilmar Abrego Garcia, deported to El Salvador in March, was returned to the United States on June 6, just as the Trump administration asked a federal court to dismiss a lawsuit demanding accountability for its delayed action in facilitating his return. 

The controversy around Garcia’s case is intensifying as federal judges weigh potential sanctions and new allegations about his conduct emerge.

Legal Battle Over Wrongful Deportation

Abrego Garcia’s legal team argues that his March 15 deportation violated multiple court orders.

Despite the Supreme Court ruling on April 10 mandating the U.S. to secure his return, they allege the government acted in “open defiance” of the judiciary until finally arranging his reentry nearly two months later.

In a scathing June 8 filing, his attorneys wrote:

“Until the government is held accountable for its blatant, willful, and persistent violations of court orders at excruciating cost to Abrego Garcia and his family, this case is not over.”

U.S. District Judge Paula Xinis, who had previously expressed frustration at the government’s lack of cooperation, must now decide whether to impose sanctions against officials who allegedly defied judicial authority. The Department of Justice, however, contends the case is now over since Garcia has returned.

Allegations of Abuse Emerge

Amid the legal wrangling, new details have emerged regarding Abrego Garcia’s alleged history of domestic violence. Court documents and prior reports indicate he had been accused of abusing his wife on multiple occasions. His wife dropped the charges and had the protective order removed.

This raises questions about his character and the broader context of the charges he now faces.

Although these allegations are unrelated to the human trafficking charges he faces now, they may complicate the public's perception and the prosecution's strategy.

What Comes Next?

Judge Xinis has ruled that Garcia’s lawyers may submit a motion for sanctions by Wednesday, potentially prolonging the legal saga.

Meanwhile, the Justice Department insists it “engaged in appropriate diplomatic discussions” with El Salvador to bring Garcia back, emphasizing that such efforts “were not certain to succeed.”
